<br />And Whereas, said Viewers filed their report therein on October 24th, 1927,

<br />and said report was duly adopted by Ordinance No. 6379, passed and approved Novem-
<br />ber 14th, 1927,
<br />
<br />And Vv'hereas, the benefits and damages were exactly equal, and by resolution
<br />

<br />duly adopted on March 19, 1928, the lien of said opening against the property
<br />
<br />benefitted was set off and cancelled by the equal amount of damages sustained,
<br />And wnereas, no appeal from the report of said Viewers and act of Council

<br />has been taken, and the time there fore has long since expired,
<br />
<br />Now, Therefore, be it resolved that the property hereinbefore described
<br />
<br />is taken and appropriated and laid out for street purposes in the widening of said
<br />
<br />8th Avenue between Jefferson and Monroe Streets, and the City Engineer is directed
<br />to prepare and deliver to the recorder an accurate plat of said street and of the
<br />
<br />property so appropriated for public use, and the _recorder is directed to file for
<br />record with the County Clerk of Lane County said plat and a cOPy of this resolu-
<br />
<br />tion.

<br />In the Matter of the Opening and Extension of Tenth Avenue West from Van

<br />Buren Street, West 114 feet, more or less, in the City of Eugene.

<br />WHEREAS, by resolution passed November 1&, 1914, the Common Council of
<br />
<br />the Ci ty of Eugene det ermined to open Tenth Avenue 'JIes t from the West line of Van
<br />
<br />Buren Street, West 114 feet, and did by Ordinance No. 1667 approve the plat anci
<br />
<br />survey of the City Engineer for said purpose and appoint the viewers for said
<br />
<br />street opening,
<br />
<br />And Whereas, the property to be taken for said street purposes is as
<br />
<br />follows:
<br />
<br />Beginning at the intersection of the North line of lOth Avenue West, if
<br />produced, with the West line of Van Buren Street, running thence West 120.75 feet,
<br />more or Ie ss, to the South East corner of LO,t 5, Block 1, of the v7allis Dorris
<br />Add. thence South 66 feet to the North East corner of Lot 1, Block 4, Wallis Dorris
<br />
<br />Add., thence East 120.75 feet" more or less, to the West line of Van Buren Street,
<br />
<br />thence North along the West line of Van Buren Street 66 feet to the place of be-
<br />
<br />ginning, containing .18 one hundredths of an acre, more or less.

<br />And Whereas, said Viewers found that the only person affected by the
<br />opening of said Street towit: James I. Diricksen was benefitted by said opening
<br />in the sum of $250.00 and damaged thereby in the sum of $250.00,
<br />
<br />And Where as, Jame s I. Diricksen obj ec ted to the report of said Vi ewel"S
<br />
<br />and said objection was over-ruled hy the Common Council of the City of Eugene on
<br />the 14 th day of June, 1915, and the report 0 f said Viewers was duly adop ted by
<br />Ordinance No. 1750, passed by the Common Council June 14, 1915,
<br />
<br />And Whereas, the time for appeal from the action of the Council and the
<br />
<br />adopting of said report has long since expired,
