<br />stated that he had received a letter from former Councilman George Monroe stating
<br />that we should not have civil service for Policemen. Father Leipzig:~addressed the
<br />Council speaking in behalf of civil service, pointing out that civil service was
<br />a mrnter of principle and that we all knew that in any case where principle was
<br />involved that we always had some errors, but that the people should be given the
<br />privilege of expressing their opinion on this subject. The Council was not passing ~
<br />the civil service, but was referring it to the people for their action. If the
<br />people voted "NOI', it was very definitely decided, and if they voted "Yes", it was
<br />very definitely decided, and was not on the shoulders of the Council. The people
<br />of the City of Eugene have certainly expressed their opinion, which was one of
<br />favor for civil service, at the last election. James H. Baker addressed the
<br />Council, endorsing 100% the statements of Father Leipzig, pointing out that many
<br />business men were in favor of this. That he certainly favored it and he was
<br />convinced tnat the people of Eugene favored it, and it shQuld be referred to them
<br />for their vote. Gordon Wells addressed the Council pointing out that he was
<br />speaking in behalf of business men and the Policemen'~ and wished to state that if
<br />this measure was not on the ballot for the May Primary, that the people were going
<br />to initiate a petition to see that it was on the ballot for the November Election.
<br />Councilman Harris pointed out that he knew there were some members of the Police
<br />force who were not in favor of civil service. Harry Johnson addressed the Council
<br />wanting to know the provisions for the replacement of Policemen who might not be
<br />giving good service to the city under civil service. Councilman Simon wanted to
<br />make this statement at the present time that there was not a dismissal from the
<br />Police force except for the betterment of the service, meaning that they were not
<br />for personal or political reasons, and that the Chief or citizens must bring in a
<br />complaint. Mayor Large pointed out that civil service did not necessarily remove
<br />a department from politics, but it was just as possible to have that condition
<br />existing under a civil service commission, therefore, we could not be assured that
<br />civil service would be a benefit 'Co the people. Councilman Harris expressed the
<br />o~inion that we should take. this very slowly. The Council shouilid deliberate in
<br />order 'Co give the people of the City the benefit of their deliberation, and so
<br />should wait until the November Election to refer this to the people. The ayes and
<br />nays were called, Councilmen voting aye 6, nay Zumwalt, and Harris, absent none,
<br />and the motion carried to present civil service for Policemen on the Primary ballot.

<br />An application from the Associated Oil Company to install an additional 20,000
<br />gallon vertical storage tank for diesel oil at their present plant at 2nd and Blair,
<br />was presented and referred to the Fire and Water Committee for action.
<br />
<br />A communication from the Drive-In-Market was presented, asking for a renewal
<br />of their temporary permit for their fruit stand. Councilman Harris moved that it
<br />be granted,. and Councilman Reid seconded it. Councilman Hendershott wanted to
<br />know what the present conditions were, and whether or not they were causing any,
<br />traffic difficulties. Councilman Bond pointed out that this is the slow time of
<br />year for fruit, but would probably have difficulty during the coming summer. The
<br />Chief of Police reported no complaints. Councilman Lamb wanted to know why it
<br />was that some could do business in a tent, and the city required others to have
<br />comcrete buildings. Engineer Clubb pointed out that this was a temporary permit,
<br />and the same expired last October, and pointed out that there was nothing in the
<br />Building Code or Fire Zone Ordinance to prohibit such a type of construction as
<br />that, but he further pointed out that they had notified them to remove the building
<br />and it had not been done. Councilman Harris's motion was lost, and this was held
<br />for further consideration.

<br />Councilman Harris wanted to know if it was right for people to sell oranges
<br />from house to house by the bucket. Attorney Calkins pointed out that it was
<br />Interstate Commerce, and the City could do nothing about it, and further pointed
<br />out that if the State made exemption from taxation on certain items, then any like
<br />items in the form of Interstate Commerce must also be exempt.

<br />Attorney Calkins was instructed to prepare an Ordinance concerning such
<br />buildings as the Drive-In-Market and trailer houses and present the same at the
<br />next Council meeting.

<br />Councilman Hendershott presented a Resolution to the effect that a committee
<br />be appointed from the Councilor otherwise to make pr6visions for a private office
<br />for the Mayor. The Recorder was requested by the Mayor to take the vote, and
<br />motion was made, seconded and carried by tne unanimous vote of the Council that
<br />this Resolution be adopted.

<br />
<br />WHEREAS, the Mayor of the City of Eugene does not
<br />
<br />have a private office at the present time,
<br />
<br />NOW, THEREFORE, be it resolved by the Common Council
<br />of the City of Eugene, that the Mayor be given the
<br />
<br />.
<br />
<br />power to appoint a committee from the Councilor
<br />
<br />otherwise to arrange for an office for the Mayor.
