<br />~fj8 <br /> <br />discussion this was left in the hands of the Park Committee to report back to the <br />38'" Council. <br /> <br />,.-,'/'; <br /> <br />I <br /> <br />Councilman Barette reported that the Irish Super Market on West 6th Street <br />:c~ had cut down trees that they were not supposed to cut and had blasted stumps with- <br />,,--, <br />~~ out a blasting permit. He stated that the Park Committee and City.EngineerClubb <br />had marked the trees that could be cut after Ntr. Irish had made a request to move <br />the trees and now they find that all the trees with the exception of one had <br />been cut. It was their recommendation that this should not be allowed and that <br />steps should be taken to rectify it. Mr. M. R. Irish addressed the council stating <br />that the removal of trees beyond those permitted were done so without his authority <br />and entirely by mistake, for which he was very sorry. City Engineer Clubb reported <br />that there was no excuse for cutting the trees that were cut. Mr. Irish again <br />stated that he was very sorry and assured them it was not intentional. Councilman <br />Barette recommended that charges be prepared and the case be brought to trial. The <br />City Attorney stated that if Mr. Barette would come to his office he would prepare <br />the complaint and he could sign the complaint and send it to the office of the City <br />Recorder where a warrant of arrest would be issued for Mr. Irish. From then on <br />the matter would be entirely in the hands of-the court, No definite action was <br />39-taken upon the recommendation. <br /> <br />Councilman Reid, Chairman of the Playground Commission requested that money <br />be expended from the City Hall account to install two screens on windows in the <br />Playground office because 'of the "bee" menace. It was ,explained that the Cit y <br />Hall account was very, very small and if money was taken from it for the screens <br />something else would have to be left undone or money taken from some other account <br />to fulfill city hall necessities. Motion was made and seconded that if screens <br />were installed the money would be expended from the Playground account. The moti0n~ <br />40'was unanimously approved. <br /> <br />Police Committee Chairman Sam Bond recommended the transfer of a Retail <br />Beer Class "Bn License and a Package Store Slass "Bn License from Elmer and Carroll <br />Roberts to Carroll C. and Mabel Roberts at Robert's Drink & Lunch at 147 East <br />4YBroadway. The Recommendation was unanimously approved. <br /> <br />The City Recorder presented a petition for the immediate vacation of <br />Indiana (26th) between Van Ness (Moss) and Central Drive because of excessive grade, <br />over 30%. The petition stated that a grade must be obtained for Central Drive for <br />the purpose of laying water main, and an immediate action would be appreciated. <br />4 The matter was referred to the Street Committee. <br /> <br />I <br /> <br />I <br /> <br />Communication was presented from the Newport Chamber of Commerce inviting <br />Mayor Large, members of the Council and the citizens of Eugene to participate in <br />Newport~s annual Crab Festival May 3, 4, and 5. Motion was made and seconded unan- <br />43 imously accepting the invitation. <br /> <br />Communication was presented from Emmaus Lutheran Church protesting that the <br />vacant lot between their church located on the corner of Almaden and West Second <br />Street, and the dwelling house to the east of the church, to be used as a wood yard. <br />The communication was 'placed on file for future reference in the event of an applica <br />44v1ltion for a woodyard at this location. <br /> <br />Request from Thomas F. Pendergast and Marie F. Pendergast to purchase a piec <br />45~of city property was referred to the Finance Committee. . <br /> <br />Communication was presented from the Board of Appeals presenting the request <br />from Marius Petersen asking for a permit to erect an apartment house on the North- <br />east corner of -the intersection of Tenth Avenue and Lawrence Street with a set-back <br />of fourteen feet "on Tenth Avenue and thirteen feet on Lawrence Street. As this is a <br />small variation from the regular set-back, the Board recommends that the request be <br />granted. Motion was made and seconded unanimously approving the reCOmInendation of <br />46"Board. <br /> <br />The Eugene Water Board presented a statement of sewerage charges billed and <br />collected showing a collection of $1,598.85 for the month of March, 1940. The City <br />Recorder was instructed to transmit to the City Attorney the names and amounts of <br />those whose payments are in arrears to the Eugene Water Board and those whose paymen s <br />47 are in arrears to the City Recorder. <br /> <br />The Eugene Public Library presented its monthly report for the month of <br />4~March. The report was ordered placed on file. <br /> <br />The ~ugene Water Board presented a copy of their annual report for the year <br />49, ending December 31, 1939. The report was ordered placed on file. <br /> <br />An application for a Second-Hand Dealers License was presented from J. E. <br />Moore of Dinty's Trading Post at 120 West 8th Street. As the application was <br />approved by the Chief of Police, motion was made and seconded unanimously app~oving <br />50~the application and a license was granted. <br /> <br />App~ications were presented from Thomas Lawhorn for a Hotel License and Mrs. <br /> <br />E. M. Doran-for a Tourist Rooming House. As both applications had been approved <br /> <br />I <br /> <br />" <br /> <br />I <br /> <br />~ <br />
