The Board <br />52 recommends that the request be denied and the recommendation was unanimously approve . <br /> <br /> <br />I <br /> <br />Communication was presented fromR. N. Stevenson asking the council's <br />consideration in taking the necessary steps to have the alley on22nd Street between <br />Hilyard and Alder Street vacated. It was pointed out that a previous vacation of th <br />alley was not a legal transaction and Mr. Stevenson had bought an adjoining lot supp <br />ing the alley had been vacated. If it were vacated, it would increase the size of <br />~his lot by seven feet. The matter was referred to the Street' Committee to report ba <br />53 at the next council meeting. <br /> <br />Request for a $7.50 refund because of an overpayment for sidewalk repairs <br />54' presented from Fred Wull schle gel' and granted. <br /> <br />Request was received from the Rugh Realty Company for a refund of $9.71 <br />\ which they had paid for sidewalk repairs and which the owner of the property, Mary <br />55 Barker, had also paid. Upon motion made and seconded the refund was granted. <br /> <br />A letter was read from Robert H. Lemon, City Auditor for the year 1941. <br />He called attention to the fact that the recorded council minutes had not been ffianua ly <br />signed, only the officer's name being typed in. City Attorney Calkins said these <br />minutes should be Signed by the Recorder or Acting Recorder. Upon motion made by <br />Councilman Farrington, seconded by Councilman Hawn it was requested that Mr. Bryan <br />be asked to sign the minutes the first time he returns to town and future minutes be <br />signed as they are recorded. Mr. Lemon also pointed out that the city bills as pres- <br />ented to to the Finance Committee were not signed by anyone as having received the <br />merchandise and there was no indication on the bills that the extension of the vario s <br />items had been ehecked. The Council instructed the Recorder's Office to have the <br />bills initialed by someone in the future verifying the extensions and also the heads <br />of the department or someone responsible must sign for having received the merchandise. <br />56 Otherwise, the bill is not to be okeyed by the Finance Committee and it was so ordere . <br /> <br />I <br /> <br />The following applications for curb cut permits were presented:No. 846 for <br />;Mike Dewey; No. 847 for OWB.n A. The City Engineer recommended that the abo e <br />lcuts be grantad and upon motion made and seconded the recommendation was unanimously <br />approved.Application for a curb cut permit was presented from Roy Hegberg, a cut of <br />~2 feet at 260 Ferry Street, and held up because the request for additional construc- <br />I~ion at this location had been denied on the recommendation of the Board of Appeals. <br />pplication for a curb cut permit was presented from the Salvation Army~a seven <br />root cut at 702 Pearl Street. The City Engineer reported that the cut was made befor <br />~he application was applied for and the owner had full knowledge of the ordinance. <br />pouncilmen Bond and Farrington both stated they thought something should be done <br />regarding these curb cuts where work was done before the permit was granted and if th <br />,ptdinance carried a penalty clause, that in this case the penalty shoul~e imposed. <br />Major Ford. of the Salvation Army was present at the meeting and took exception to the <br />~tatelnent that the work was done before the application was applied for but admitted <br />~e had cut the curb before securing the permit from the council. It was pointed out <br />~hat this situation had developed several times before with other curb cuts. <br />Founcilman Stewart pointed out that this request was not for peFsonaluse but for the <br />~e of the Salvation Army and he moved that the penalty in thispase be waived. Chief of Police Bergman reported he had investigated the barn on Elk Avenue <br />WhiCh matter had been referred to him at a previous council meeting. He and City <br />Attorney Calkins had contacted Mr. McDully, 'owner of the barn, and learned that goods <br />were stored there at the present time but as soon as a suitable location could be <br />4 found, the gOQds would be removed and the barn torn down.
