<br />.Mr. Mencke appeared before the Council with an oral request for a re-

<br />Addition stating that ~he original application had been denied on February 4,
<br />1946 by the City Planning Commission but that changes and property ownership in
<br />that area had removed the objection voiced at that time.

<br />Mr. Geo. W. Miltonberger appeared before the Council appealing a recom-
<br />mendation of the Board of Appeals entered ~mrch 11, 1946 denying waiver of set-back
<br />for house at 21st and Hilyard.
<br />
<br />After some discussion, the Council upon motion duly made and carried, ordered the
<br />appeal referred back to the Board ~f Appeals for further investigation.
<br />
<br />Mr. Andrews, 563 Jefferson addressed the Council stating that he had
<br />secured a permit to construct a 5 apartment building at that address, one of the
<br />apartments being in the basement. He stated that today the Building Inspector
<br />had told him that he could not complete the building with 5 apartments in that
<br />zone.. After an investigation by the Engineer he stated that Mr. Andrews had a
<br />valid building permit and that it was his recommendation that Mr. Andrews be
<br />allowed to complete the building. Upon motion the recoffilllendation of the Engineer
<br />was adopted by the Council.

<br />ORDINANCES
<br />
<br />Council Bill No. 84 -- Re: Vacation of alley, Block 35, Fairmount
<br />Addition, which was given first reading March 11th and further action deferred,
<br />pending consent of the abutting property owners, was brought before the Council
<br />for its consideration. It, was reported to the Council that the consent of the
<br />property owners, previously protesting the vacation, ~ad been obtained.
<br />
<br />It was moved by Koppe, seconded by Hawn that the ordinance be placed on its
<br />second reading. Motion carried.
<br />
<br />It was moved by Koppe, seconded by Hawn that the rules be suspended by unanimous
<br />consent and the ordinance be given third reading and placed on final passage. All
<br />councilmen present voting AYE, the ordinance was declared passed and numbered 8890.
<br />
<br />Council Bill No. 86 -- He: Levying of a tax upon theatrical and other
<br />exhibitions, shows and public amusements, was submitted and read the first time.
<br />
<br />It was moved by Crumbaker, seconded by Hawn that Council Bill No. 86 be amended
<br />to read "5% of total admissions."
