<br /> to as County, and CITY OF EUGENE, a municipal corporation of Lane County, Oregon, by; I
<br /> .and through its City Manager, acting pursuant to Resolution of the Common Council I,

<br /> WHEREAS , Jefferson Street within said City and County, is considered a primary
<br /> street for the flow of North and South traffic through said city and leading
<br /> directly thereto particularly from the junction of said Jefferson St., if extended,
<br /> with the Lorane Highway, a County Road, and,
<br /> ~
<br /> WHEREAS, it is deemed to the best interests of said County 'and said City that
<br /> provision be made for the ultimate opening, construction. and improvement of said
<br /> -Jefferson Street from the corporate limits of said City southerly to the junction
<br /> of said street with the aforesaid Lorane Highway, ahd, further, provision for the
<br /> proportion which each shall contribute towards the cost of such construction and
<br /> improvement.
<br /> NOW, THEREFORE, pursuant to the premises and powers vested in said County and
<br /> City by Section 100-2410, O.C.L.A., it is mutually agreed between the County and
<br /> City as follows:
<br /> 1. The County shall forthwith take .the necessary steps to acquire, by purchase
<br /> or eminent domain, good and sufficient title for county roadway purposes to neces-
<br /> sary lands for an extension of said Jefferson Street betweffnYoung's Lane and the
<br /> Lorane Highway, and the County sha 11, upon acquiring such lands, declare the same I
<br /> a County Road.
<br /> .
<br /> That the proportion which the City shall contribute towards the cost of such
<br /> construction and improvement shall be the cost of acquiring title by the County
<br /> as above agreed, and the City~agrees to pay ail costs of whatsoever nature arising
<br /> or growing out of the acquisition of title to said lands directly to the persons or
<br /> parties invol ved ~nd to save the County free and harmless from any liability cost.
<br /> and expense whatsoever on account of acquiring said lands.

<br /> 3. That the proportion which the County shall contribute to the cost of 1
<br /> construction and improvement of said roadway shall be the cost of construction and '.
<br /> surfacing Jefferson Street between Young's Lane and the Lorane Highway aforesaid, , ;
<br /> upon the lands to be acquired as aforesaid, and the County agrees that it will, "
<br /> within two years from the date of acquiring the lands aforesaid, construct and L
