THE' CITY ATTORNEY <br />EXPLAINED THAT, IN HIS OPINION, THE REZONING REQUEST SHOULD BE riLED BY MR. KORSTAO AND <br />THAT SUCH PETITION SHOULD GO TO THE PLANNING COMMISSION F'OR 'CONSIDERATION'lrT THEIR <br />MEET I NG, I N MARCH OF' 1956. ,:TH I S ACT ION WAS DEEMED NECESSARY SINCE THE PROPERTY I SNOW <br />PROPOSED TO BE ZONED C-3P AND ~LSO SINCE THE ORIGINAL ORDINANCE WHICH WAS DRAWN IN 1952 <br />PROPOSED TO AMEND THE BASIC ZONING ORDINANCE IN EXISTENCE AT THAT TIME, BEING ORDINANCE <br />NUMBER 9188, WHICH HAS SINCE BEEN REPEALED A~D NULL1F'IED. <br /> <br />I <br /> <br />IT WAS ~IKEWISE POI~TED OUT TO MR. KORSTAD THAT HE WOULD NOT BE ABLE TO CONTINUE <br />BUI LDI NG UNTrL REZONI'NG HAD BEENi-ACCOMPLISHEth THE COMMI TTEE RECOMMENDED THAT THE <br />REZONING REQUEST OF' MR. KORSTAD BE RErERRED TO'~HE PLANNING COMMISSION AT THEIR ~EETING <br />TO BE' HELD MARCH 6" 1956 F'OR THEIR. DONALD SHORT'. HE FURTHER INDICATED THAT HE UNDER- <br />STOOD MR'. SttOR'T WAS WILLING TO SETTLE I~ NO ASSESSMENT WERE MADE AGAINST HIS PROPERTY FOR <br />THEOPENING OF GAR~IELD STREET. <br /> <br />- <br /> <br />THE COMMITTEE DISCUSSED THIS MATTER AND LIKEWISE DISCUSSED THE MATTER OF' ASSESSMENT <br />LEVIED AGAINST PROPERTY OWNED BY MR. W. E. BAXTER. MR. BAXTER HAS AGREED TO A REDUCTION <br />OF' HIS ASSESSMENT 'FROM $541.25 TO $270.00. IT BEING THE COMMITTEE'S~Ei.fE~ THAT MR. BAXTER <br />AND MR. SHORT WERE IN EQUIVALENT POSITIONS WITH RErERENCE TO ASSESSMENT or ElENEF'lTS F'OR <br />THE OPENING OF' GARrlELD STREET, THE COMMITTEE RECOMMENDED THAT DUE TO THE URGENCY or <br />THE COMPLETION OF' GARFIELD STREET THAT MR. SHORT'S ElENErlT ASSESSMENT'OF' $227.60 BE <br />CANCELLED AND THAT BECAUSE O~ THE EQUIVAL6NCY OF' MR.
