<br /> 1 1. November 14, 1966 Council Meeting - The Council's wishes were invited concerning the
<br /> November 14, 1966 meeting, since the League of Oregon Cities annual meeting will ~e
<br /> in session in Portland on that date. It was agreed to hold the first meeting in
<br /> November on the 7th, and to set the hearing date on the parking structure for the. . - -.. I

<br /> 21st in order to meet legal requirements for calling the public hearing.

<br /> Mr. Hawk moved seconded by Mrs. Lauris to approve Item 1 of the Committee rep~rt. Motion carried.
<br /> 2 2. Sewer Assessments, Hawthorne Street - Letters from James E. Hyer, .3791 Hawthorne Street;
<br /> were read concerning relief on assessment for construction of Bethe1-Danebo sewers. It
<br /> was explained that sewer assessments are normally computed using a 160-foot depth on
<br /> lots abutting construction. The lots on th~ north side of Hawthorne Street between
<br /> Berntzen and Baocter are 57 feet from the front property line to the BPA, dr ai nage, and.
<br /> EWEB easements ['at the rear. Owners of abou~ 20 prop~rties involved indicated through
<br /> Mr. Hyer they had expected assessments acco~ding to front footage or connections; and
<br /> maintain they are penalized if assessed for 'the 160-foot depth when the easements re-
<br /> strict them to 57 feet. The C:i,ty Attorney's written opinion stated .there is no dif-
<br /> ference between these lots with regard.to the easements than other lots having"side-
<br /> walk setback, etc. , since the owners have use of the entire properties except the
<br /> privilege of building on the easements. Dr. Purdy moved seconded by Mr. Hawk to ~ake
<br /> the sewer assessment on the l60-foot depth and to forego the ~~ per sq.ft. charge over
<br /> and beyond the l60-foot depth.. Motion carried.'

<br /> Mr. Hawk moved seconded by Mrs. Lauris to approve Item~2 of the Committee report.
<br /> James Hyer, 3791 Hawthorne Street, speaking for owners of properties on the north side of Hawthorne
<br /> Street, presented a petition from these residents protesting the.amount of assessment for this sewer Ii
<br /> construction, and made~furth~r presentation with t~ansparencies pointing out restrictions imposed on >-
<br /> the properties by the easements. at the rear. ' - "
<br /> Joseph C. Lutz, 3797,Hawthorne Street, stated properites on the south side of Hawthorne Street would
<br /> pay only about 75% of what the owners on the north side would pay for the same. benefit but with more
<br /> usable property. He requested that the Council base the assessment for the lots on the north side of
<br /> Hawthorne on an 8l-foot depth plus 20 feet of the easement, for a total of 101 feet, instead of the
<br /> 160 feet recommended, and if this request is not granted, he requested a reasonable amount of time in e
<br /> which to investigate the possibility of transferring title of the properties to parties having the
<br /> first interest. Mr. Hyer explained the possibility of deeding to BPA that part of the property under
<br /> easement. In answer to a qu~stion from Councilman Purdy concerqing.assessing the property if in the
<br /> owpership of.BPA, the City Attorney said the BPA~ beiqg a Federal agency, could not be assessed.

<br /> The Director of Public Works and Administrative Assistant explained some alternative methods' of
<br /> assessing for the sewer construction such as assessing:a1l lots in the construction area equally
<br /> (roughly estimated at $634), ,assessing on an 80-foot depth (roughly estimated at $378), or assessing
<br /> on l60-foot depth (roughly e~timated at $710). None of the figures. given included the .~~ per sq.ft.
<br /> assessment for trunk line construction. . ,.
<br /> Councilman Lasssn entered the meeting at.this time.
<br /> Mr. Hawk commented that any lessening of assessment for properties on the north side of Hawthorne
<br /> would result in raising assessments for owners.on the south side, property owners were aware of the I
<br /> easements at the time they purchased their properties, and"properties on the'north side of. the street
<br /> are benefited from the sewer installation regardless of any easement restrictions.
<br /> I Mrs. Lauris withdrew her second of the motion. Mr. Lassen then seconded the motion after commenting
<br /> that he had viewed the properties in question and that the properties under e?sement are being used.
<br /> A vote was taken on the motion to approve Committee action, and motion carried, ~rs. Lauris voting no.
<br /> .~~ Mrs. Lauris asked about a.storm sewer to replace the drainage ditch at the rear of the prop~rties,

<br /> and was informed th~t this area is included in the planning for storm sewers for the entire area.
