Vacation Alley between Almaden and Fillmore south of 7th - A report from the City <br />Attorney was presented explaining vacation of this alley accomplished July 25, 1966 <br />failed to reserve utility easements. A new ordinance was presented which would <br />repeal.;the original vacating ordinance, then vacate the alley with reservation of <br />utility easements. It was agreed to present the correcting ordinance for passage <br />at the January 9, 1967 Council meeting. <br /> <br />Dr. Purdy moved seconded by Mr. Anderson that Item 6 of the Committee report be received and filed. <br />Motion carried. <br /> <br />2 <br /> <br />7. Liquor License Applications, approved by Police Department. <br />Package Store Class B - McCabe's, 1684 West 18th (Change of Ownership - <br />Robert Creasey, formerly McCabe Bros., Inc.) <br />Retail Malt Beverage Class B - Jonesey's Snappy Service #3, 453 Willamette <br />Mr. Anderson moved seconded by Mr. McNutt to recommend approval. Sewer Assessmerr, BD-65-8 ~ Council members had toured the area of sewer construction <br />in Bethel-Danebo for whicha public hearing on assessments will be held January 9,1967, <br />and general discussion was held concerning assessment onGilbert Subdivision and Shop- <br />ping Center. <br /> <br />4 <br /> <br />9. Policy, Lateral Sewer Connections - Council members were asked concerning policy with <br />regard to running sewer stubs to property lines or requiring each property owner to <br />make his own connection. It was agreed the policy would remain unchanged, and stubs <br />would be run to property lines at the time laterals are constructed. The question <br />was also raised whether to make the lateral installations behind the curb or in the <br />street, and it was agreed that each case would be considered at the, time of connection. <br />Council members further agreed that lateral systems should be completed in the West <br />11th, West 18th, and Acorn Park areas. With regard to sewers in. the northwest corner <br />of Bethel-Danebo, it was decided to consult the County Health Department concerning <br />need, and then to inform the residents of the area and request an indication from <br />them as to whether they wish the City to proceed with installation of sewers." <br /> <br />Dr. Purdy moved seconded by Mr. Anderson that Items 8 and 9 of the Committee report be received and <br />filed. Motion carried. . <br /> <br />Committee meeting held January 5, 1967: <br /> <br />"Present: Mayor Cone; Councilmen Lauris, Purdy, McNutt, Anderson, Lassen, Hayward, <br />McDonald, and Wingard; City Manager and staff; and others. <br /> <br />5 <br /> <br />1. Traffic Safety Awards - Venita Howard of the State Department of Motor Vehicles was <br />introduced. Miss Howard, on behalf of the Oregon Traffic Safety Commission, pre- <br />sented an award to Richard J. Rementeria for the New Car Dealers Association for <br />their vehicle safety check program in Eugene. She also presented an award to Mayor <br />Cone for the city of Eugene in recognition of the traffic record improvement made <br />in 1965, commenting that it is one of. only three awarded in the State and that it <br />recognized a reduction in traffic accidents and in injuries and deaths resulting <br />from traffic accidents. <br /> <br />6 <br /> <br />2. Skinners Butte Cross - The City Attorney reported that Judge Fort ruled the City <br />does not have authority under State law or under its Charter to permit a religious <br />symbol on City park property, and that the Cross atop Skinners Butte should be re- <br />moved. The Judge did not rule on any constitutional issues involved. Mayor Cone <br />suggested the item be scheduled on' some future agenda to determine whether to <br />take the issue to a higher court. <br /> <br />7 <br /> <br />3. Bethel-Danebo Sewer Assessment, Pro;ect BD~65-8 - A summary cr. this project from the <br />Public Works. Department was read. The summary reviewed the bids submitted and <br />stated there were no objections at the public hearing when the. contract was awarded. <br />The cost estimated at that time was .3~ less than the actual cost of 6~ per square <br />foot computed upon completion of the project. The Public Works Director again ex- <br />plained the policy change which now requires construction of stubs to the property <br />lines instead of lateral sewer construction only. He also commented on the extent <br />of the contractor's obligation with regard to street repair after completion of <br />the proj ect. <br /> <br />8 <br /> <br />4. Sewer Assessment, Gilbert Shopping Center, BD-65-8 - Kenneth Gilbert requested re- <br />lief from assessment for the sewer constructed from Fairfield Street east through <br />his property to serve. the Shopping Center and three properties not in his ownership <br />facing Highway 99N. A report was read from the Public Works Department outlining <br />the history of design and construction of this line, and stating the only possible <br />relief might be deferment. of assessment againstthat portion of the property now un- <br />developed until such time as buildings are constructed and sewer connections re- <br />quested. Kenneth Gilbert was present and reviewed his request for relief on the <br />basis that at no cost to the City he granted the easement through his property on <br /> <br />which the sewer is constructed, and on the basis that he could have served his prop- <br />erties from the line constructed on Fairfield.
