The Public Works Department recommended <br />delay of the Polk Street paving if it is decided not to c'Onstruct the sewer at ,this <br />time, and to proceed with paving Cross Street. No action was taken. <br /> <br />1 <br /> <br />The City Manager again reviewed the history of the sewer line now in use on North Polk, and explained <br />that only owners of those properties no having been assessed will have to pay an assessment for con- <br />nection to the new line. He said construction is necessary to complete the separation of storm and <br />sanitary sewers in this area. James D. Campbell, 1360 S~nny Drive and owner of property at 280 North <br />Polk; Mrs. Wallace Stein, 93 North Polk; and Mrs. K. W. Peterson, 273 North Polk stated their objec- <br />tions to the new line. Councilman Anderson asked whether property owners could take legal action <br />against the City for assessment against their properties if they had already entered into a contract <br />with the City in 1914 for sewer service. The City Attorney said there is nothing which would legally <br />prevent the City from installing the sewer and levying the assessment. <br /> <br />Dr. Purdy moved seconded by Mr. Anderson to proceed with paving Cross Street. Rollcall vote. All <br />councilmen present voting aye, motion carried. <br /> <br />e <br /> <br />Dr. Purdy moved seconded by Mr. Anderson to proceed with sewer and paving on North Polk Street. <br />Rol~call vote. Motion defeated, Councilmen Purdy, McNutt, and Lassen voting aye; Councilmen Lauris, <br />Anderson, Hayward,McDonald, and Wingard voting no. <br /> <br />1 <br /> <br />4. Assessment. Paving and Sidewalk 27th from Columbia to Spring. Boulevard - Council members <br />were apprised of reasons for increased amount of actual assessment over the original <br />estimated costs. A public hearing is scheduled for the March 27, 1967 Council meeting. <br />No action was taken. <br /> <br />I <br /> <br />Dr. Purdy moved seconded by Mr. Anderson that Item 4 of the Committee report be received and filed. <br />Motion carried. <br /> <br />2 <br /> <br />5. House Moving. 955 East 43rd - The City Attorney's op~n~on was read with regard to com- <br />plaint from Henry Baitis concerning a house moved to 955 East 43rd, and on which a <br />"stop work" order was issued. The opinion stated unless the permit was issued in <br />error or as a result of misrepresentation, it cannot be revoked. Mr. Anderson moved <br />seconded by Dr. Purdy to rescind the "stop work" order. Motion carried. <br /> <br />Some discussion ensued as to time limit for completing the house and requirements for <br />landscaping, and on general rules and regulations governing house moving in the City. <br />The Superintendent of Building Inspection said a detailed outline is being drafted of <br />more restrictive procedures o:n house moving which will be presented to the Council <br />for consideration. <br /> <br />Dr. Purdy m<?ved second~d..by Mr. Anderson to approve Item 5 of the .Comniittee report. <br /> <br />Henry Baitis, 1930 Buck Street, owner of property adjacent to 955 East 43id Avenue, offered to pay <br />the fee to have three appraisers determine the life of the house after being moved to this location. <br />He again stated his objections, drawing attention to what he felt were features detrimental to the <br />area. Also voicing objections were George Houts, 4130 West Amazon Drive; Ronald Dykes, 4745 Brook- <br />wood Street; and K, J. Braun, 5550 West Amazon Drive. Elmer Sahlstrom, 715 Fair .Oaks Drive, one of <br />the owners of the house moved, commented on work planned to bring the house to Code requirements. <br /> <br />I' <br /> <br />A vote was taken on the motion to rescind the "stop work" order, and motioq carried, Mrs. Lauris <br />voting no. <br /> <br />3 <br /> <br />6. Public Works Bids. Opened March 15. 1967 - The Public Wqrks Department recommended <br />holding award of contract for paving Rocky Lane for 45 days pending right-af-way <br />acquisition; award of contract to low bidder for paving streets in Cummins Park, <br />subject to approval of the developer; and award of contracts to low bidders on' each <br />of the other projects. Mrs. Lauris moved seconded by Dr. Purdy to approve the recom- <br />mendations. Motion carried. <br /> <br />e <br /> <br />4 <br /> <br />7. Public Works Bids. Opened March 21. 1967 - Basic bids'submitted for sanitary sewer <br />installation iq Willakenzie Sewer Improvement District WS-67-l covered installation <br />of the line' behind the curb, 'except on Rustic south of Sorrel and a portion of' Dait- <br />moor south of Harlow Road. In those two' areas the basic bids were 'for {nstallation <br />in the street. Alternates submitted by the low bidder were shown for installation <br />in the;street in ni~e different area~~ and' ranged 'fiom an additional'~/10ihs~e~t <br />to 81:2<; per square foot. . Mrs. Lauri ~ moved seconded by Mr. "Anderson to award con- <br />tract to the low bidder as recommended'by the Public Works Department. Motion carried. <br /> <br />Dr. Purdy moved seconded by Mr. Anderson that Items 6 and 7 be"rece{ved arid filed (see action under <br />Bids earlier in meeting). Property Purchase. 7th and Willamette Parking District - The City Manager informed <br />~he Council that options taken on the Millican property for $70,000 and on the Steen <br />property for $55,0~0 ~ill expire April 1, 1967. He stated the prices of both prop- <br />erties, located in the quarter-block at the northeast corner of 7th'and Willamette <br />to be acquired for off-street parking; are reasonable. Mr. Anderson moved seconded <br />by Mr. McNutt to proceed with acquisition of the properties.'
