<br />- <br /> <br />~ <br />32.1. <br /> <br />5/22/67 <br /> <br />I <br /> <br />e <br /> <br />I <br /> <br />I <br /> <br />e <br /> <br />I <br /> <br />e <br /> <br />The Public Works Department again recommended location of the sewer line on Stewart Road rather than <br />along the Amazon as requested by Attorney Winfrid Liepe, representing owners of the M. L. Martinson <br />property. Estimated cost for construction on the alternate route was $.0392 per square foot, and <br />construction of the alternate route would merely transfer cost of the sewer from one property owner <br />to another. <br /> <br />Attonney Liepe reviewed contentions he previously presented that the alternate route is more logical, <br />and requested the Council to reject the route proposed by the Public Works Department. <br /> <br />The City Manager said the sewer on Stewart Road east of Wallis Street has not been abandoned; it has <br />merely been postponed, probably for one year. He read a letter from John Stoner, County sanitarian, <br />concerning drainage in that area. <br /> <br />A rollcall vote was taken on the motion, and motion carried - Councilmen Purdy, McNutt, Anderson, <br />Lassen, and McDonald voting aye; Councilwomen Lauris and Hayward voting no; and Councilman Wingard <br />abstaining, asking that the record show he took no part in the discussion. <br /> <br />1 <br /> <br />2. Public Affairs Conference - Mayor Cone announced a Public Affairs Conference to be held <br />at the University of Oregon on June 15-17, 1967. <br /> <br />No action was taken. <br /> <br />2 <br /> <br />3. Staff Appeal. Electrical Board Decision. Fire Walls - A memo was read from the Superin- <br />tendent of Building Inspection appealing the decision of the Electrical Board with re- <br />gard to a building under construction at 2365 Cal Young Road. The National Electrical <br />Contractors contend, and were upheld by the Electrical Board, that the proposed walls <br />separating units in the building do not constitute fire walls as defined by State <br />rules, and that the building should be wired as one multi-family unit, requiring metal <br />conduit, rather than as separate units in which case portions of the wiring can be in- <br />stalled in non-metal conduit. A permit was issued by the Building Department for the <br />building in question in line with the Building Code adopted by the. City which allows <br />multiple units in one building to be separated by fire walls as defined in the Code. <br />The Building Department maintains the Code sets higher standards for fire walls than <br />required by the State rules. <br /> <br />Allen Hamilton and Don Robinson, members of the Electrical Board, stated the Board's <br />reasons for upholding the Electrical Contractors in their appeal to abide by the <br />State's definition of fire walls. Jack Shiller and Del Randall, speaking for the <br />National Electrical Contractors Association, and Les Lynch, acting chief electrical <br />inspector for the state of Oregon, cited the State regulations and reviewed their <br />objections to the method of wiring permitted in the building under construction. <br /> <br />Mr. Wingard moved to overrule the Electrical Board. There was no second. <br /> <br />Dave Hoffman, local electrical contractor and member of the Planning Commission, re- <br />marked that approval of the type of wiring used in the Cal Young building would con- <br />stitute a major change in enforcement, and said he felt it would create confusion in <br />the industry in making decision with regard to wiring multiple-family buildings. <br />The City Attorney said the matter appears to be one of disagreement between the State <br />and the City on the definition of fire walls. The Superintendent of Building In- <br />spection said his department is now drafting suggested amendments to the State's <br />rules where conflict appears between the State and City, and that these amendments <br />will be brought to the Council for submission to the State Electrical Board. <br /> <br />Dr. Purdy moved seconded by Mr. Wingard to uphold the staff on the wiring method <br />used in the building under construction at 2365 Cal Young Road, and to withhold <br />issuance of permits for construction of any other buildings of this type using the <br />challenged wiring method until the conflicts between the State administrative rules <br />and the City Code are resolved. Motion carried.' <br /> <br />3 <br /> <br />4. Danebo Fire Station - Bill Wilson, architect, showed sketches and described the <br />design of the proposed new fire station to be located on the west side of Berntzen <br />Road between Elmira Road and Bell Avenue. The station is estimated to cost $70,920, <br />exclusive of landscaping, for about 4700 square feet, or approximately $12.85 per <br />square foot. Fire Chief Smith recommended approval. Mr. McNutt moved seconded by <br />Mr. Anderson to approve the design. Motion carried. <br /> <br />4 <br /> <br />5. Landscaping. Herzog Mobile Homes. 1700 Highway 99N - An agreement was entered into <br />by Clinton Hedrick, manager of Herzog Mobile Homes, and the City setting forth condi- <br />tions to be met by Mr. Hedrick in connection with rezoning his property. Landscaping <br />called for in the agreement has not been started, and the City notified Mr. Hedrick <br />that unless he installs the landscaping within six months, the City will proceed with <br />the planting and assess the cost to the property, as provided in the agreement. <br />Mr. Hedrick stated several reasons for not having completed the terms of the agree- <br />ment. Mrs. Gordon Barron, 1540 Hughes Street, requested action on the planting. <br />Mr. McNutt moved seconded by Dr. Purdy to enforce the terms of the agreement. <br />Motion carried." <br /> <br />Dr. Purdy moved seconded by Mr. Anderson to approve Items 3 through 5 of the Committee report. <br />Motion carried. <br /> <br />5/22/67 - 10 ll~ <br />
