<br />1. Planning Commission Report - April 24. 1967
<br />a. Rezone to R-4, Agate south of 19th; Cummins - The Planning Commission recommended,
<br />denial of R-4, but recommended the area be rezoned R-3G.

<br />Items on May 18, 1967 Committee agenda 'not considered, at that time:

<br />J ames Weaver,: representi:ng Lenore: Cummins, said the R-3G zone would be satisfactory
<br />for ~heir purposes, and" answered several questions from Council members- with regard
<br />to number of units planned in the development.
<br />
<br />,Mayo~ Cone left the meeting, and Councilman Purdy assumed the ,Chair.
<br />
<br />DeNorval Unthank, architect for the project, also answered questions from the
<br />Council;
<br />
<br />Vern Gleaves, at~orney representing Dale Fischer, 2105 Fairmouot Boulevard,
<br />stated his client is definitely opposed to an R-4 zone, and not too happy with
<br />an R-3G zone in that 'area. : He reviewed the history of this property with regard
<br />to the Council's refusal of previous"rezoning- requests, and said that no' higher
<br />density than that of R-2 should be allowed.

<br />Others opposing the rezoning were Mrs. Roland Rodman, 2026 Agate; W. L". Miller,
<br />2116 Agate; Mrs. Jack Gilbert, 1990 Agate; and Ken" Smith, 1935 Columbia. A
<br />petition opposing the rezoning was also Fr~sented signed by residents of the
<br />area and addressed to. the Planning Commission.

<br />Mayor Cone retur~ed to the meeting and assumed the Chair.

<br />Mr. Weaver sa~d ,the petit:ioner could not accept an R-2 zone and, that they f.elt
<br />a higher density is necessary. Councilman Wingard commented that the, site is
<br />e.~cellent for condominium development.

<br />Dr. Purdy moveq- seconded by Mr. McDonald to uphold the Pl~ning Commission in their recommendation
<br />for R-3G zone. Motion defeated, Mr. McDonald voting yes.
<br />
<br />The City Manager s,aj"d tpe item would be referred to a joint meeting of the Council and
<br />Planning Gommission.

<br />R. Rezone t'o C-3P. 11th 'and City View. Hamilton -The ~lanning ,Commission reaffirmed
<br />its recommendation for requiring a fence, hedge, or wall as a condition of rezoning.
<br />A 1etter was prese~ted from Charl~s Porter~ attorney for the petitioner, Bhurl
<br />Ha,milton, withdrawing their request for ,temporary waiver of the fence requirement.

<br />3. Planning Commission Report - May 8. 1967,
<br />a. Rezone from RA and M-3 to M-2,north of Stewart Road between Bertelsen- Road and
<br />Bailey ,Hill Road. Shirley - The ~lanning ~ommiss~on recommended rezoning to M-2
<br />the are.a 'now zoned M-3, but re~ommended deni-al :of rezoning the RA area to M-2.
<br />Robert Shirley as~ed seve.ral questions with regard to use of the enti~e~property
<br />for trailer park purposes. He. was told ~hat i~ was understood a trailer park _
<br />would be allowed on the RA portion of tre property under a conditional use permit,
<br />and that the conditional use has 'been granted and a permit would be issued upon
<br />presentation of plans and approval of the plans by the Planning Commission.

<br />Dr. Purdy moved se.conded by Mr. :Anderson to approve the Planning Commission' recommendat ion. Mot ion
<br />carried.

<br />4. Rural Fire Protection District Contract Rates - Copies of a report comparing cost.
<br />of fi,re 'protection insid~ the City with that for rural fire. districtswer~ previously
<br />distribu~ed to Council members, and to the rural fire .districts. The City Manager .re-
<br />ported that one district said they felt they should serioesly consider ,providing their
<br />own fire protection. He suggested the possibility of a four-year program of adjusting
<br />the charget,o districts to more :nearly compare with the cost ~or protection inside the
<br />City. The program would raise the charge to 6~ mills in 1968-69, 7 mills in 1969-70,
<br />7~ mills in 1970-71, and 8 mills in 1971-72.
