All councilmen present voting aye, the bill was declared passed and numbered 14941. <br /> <br />2 Council Bill No. 8119 - Rezoning conditionally to R-3G area near southeast corner of 19th Avenue I' <br />and Agate Street (Weaver-Cummins), was submitted and read in full. <br /> <br />A performa~ce agreement was also: submitted, as a condi~ion of'the r~zoning.' <br /> <br />It was explained that the develope.r, James. Weaver~':now wants' to build five units only on the southerly <br />portion of the property, and because of this change in his plans as previously presented, the item was <br />taken back for consideration of the Planning Commission. The Planning Commission recommended 'denial <br />of the rezoning unless developed according to the original plan(see permanent repor~ of Planning <br />l T - . . ~ . "', . <br />Commission, July 24; 1967) .'" . . . <br /> <br />Mr. Weaver said the performance agreement was satisfactory but'that de~elopnient of the entire project <br />'was a matter of financing, and asked that.the agreement b~ held'until he arranges .fina~cing f~~ the <br />entire proj ect. <br /> <br />Sam Hughes, 2700 Fairmount Boulevard, reviewed the hist6ry bf :p'r~vious rezoni"ng 'requests for this' <br />property and urged denial since t.here has been no change in' the surrounding area. He quest ioned the <br />legal status of the petition for~eioning 'i'ns'ofar' .as Mr. Weaver' s owner~hip of the 'pr'operty was con- <br />cerned;.... <br /> <br />Mrs. Lauris remarked that she ~elt the development would d~finite11 improve the area. I <br /> <br />Vern Gleaves, representing Dale Fischer, 2105 Fairmount Boulevard, opposed the rezoning, citing as I <br />reasons increase in d~nsity and.pote,ntial increase in traffic. He said the,rezon,ing appeared to be I I <br />for one'person's benefit; and he also questioned Mr. Weaver's ownership of a portion of the property. <br /> <br />Other speaking against the rezoning were Francis Nickerson, 196rr Agate S~reet; Kenneth Smith, 1935 <br />Columbia Street; Larry Burr, 1969 Columbia Street; Daniel Gilbert., 1990 Agate Street. A letter was <br />presented 'from Fred and Jacqueline Mohr, 2112 Agate StreeL, in favor of'the rezoning. <br /> <br />Mayor Cone returned; Councilman Purdy retained the Chair. <br /> <br />Mr. Anderro n moved seconded by Mrs'. .Lauris that the council bill be read the second time by council e <br />hill number only, with unanimous consent of the Council: 'Rollcall vote. Motion defeated, Councilmen <br />Wingard and McDonald voting no.
