<br /> a. Vacation Keeler Avenue east from Sweet Gum Lane, Rogers - The Planning Commission
<br /> recommended denial of the vacation request by Wyatt S. Rogers on the basis that
<br /> the street will be necessary to subdivide properties to the east. Dr. Purdy
<br /> moved seconded by Mr. Lassen to deny the vacation. Motion carried.
<br /> 2 b. Vacation Utility Easement, 28th and Taylor, Chowning - The Planning Commission
<br /> recommended approval of request from Noble Chowning to vacate a 7-foot easement
<br /> along the south line of Lot 10, Block 7, 7th Addition to Ellendale. The Planning
<br /> Director said the easement will not be needed since relocation of the sewer.
<br /> 3 c. Vacation Utility Easement, west of Candlelight Drive, Gilb ert - The Planning Com-
<br /> mission recommended approval of request from Kenneth Gilbert to vacate a IS-foot
<br /> easement along the west ,line of Candlelight Park.
<br /> Dr. Purdy moved seconded by Mr. Lassen to approve the vacation of both utility ease-
<br />e ments. Motion carried.
<br /> Dr. Purdy moved seconded by Mr. Anderson to approve Items 9a, 9b, and 9c of the Committee report.
<br /> Motion carried.
<br /> 4 d. Condit ional Use, Group Foster Home, Valhalla Street - The Planning Commission
<br /> granted the Lane Juvenile Department a conditional use permit whichwould allow
<br />I a group foster home on Valhalla Street just north of Jeppeson Acres Road for
<br /> eight girls, with no'more than ten girls for short periods, and with review of
<br /> the permit should three formal, written complaints be filed from neighbors living
<br /> within 200 feet of the property. Several letters were addressed to the Council
<br /> requesting reversal of the Planning Commission decision. Councilman Lassen asked
<br /> if a time limit of one year could be set for review. It was explained the Juve-
<br /> nile Department is leasing the house and any time limitation on the permit would
<br /> create lease problems, and any scheduled hearing would tend to create neighborhood
<br /> problems. The Planning Commission felt the provision for review upon complaint
<br /> of three neighbors would provide any review necessary. No action was takm It
<br /> was understood the item would be before the Council for further consideration at
<br /> its December 11 meeting.
<br /> The City Council previously viewed the site, and a slide was presented showing residences of those in
<br /> the neighborhood objecting to the home at 1935 Valhalla Street. Arnold Droge of the Lane Juvenile
<br /> Department explained the purpose of the home and its proposed operation. He said a similar home for
<br /> boys recently in operation on Bailey Hill Road gives no complaint, and that a survey of neighbor s
<br /> in the Valhalla neighborhood prior to the Planning Commission hearing resulted in only one objection.
<br /> Protests were voiced by residents of the Valhalla Street area on the basis of undesirable association
<br /> for younger children in the neighborhood, increase in traffic and teenage drivers, devaluation of
<br /> properties, and not being beneficial to girls in the home if neighborhood objects. Those objecting
<br /> were Mr. and Mrs. Chester Frew, 1960 Valhalla; Mr. and Mrs. Tom Kokkeler, 2127 Valhalla; Duane Sand-
<br /> berg, 2143 Valhalla; William Harman, 1990 Valhalla; Kenneth Pickett, 2158 Valhalla; Richard Kennedy,
<br />I 2270 Valhalla; J. B. Webster, 2126 Valhalla; Mrs. B. E. Thalman, 2725 Jeppeson Acres Drive;
<br /> Terry Paulsen, 2035 Medina; and Mrs. Ralph Miller, 2575 Jeppeson Acres Drive.
<br /> Mrs. M. C. Petersen, 2215 Valhalla, suggested a rural area for location of the home, and Mr. Droge
<br /> explained the purpose of the group home is to integrate the children into the community, whereas a
<br /> rural location would tend to isolate them even more. Conversation followed between Council members,
<br /> Mr. Droge, and Jewel Goddard, also of the Lane Juvenile Department, with regard to average age of the
<br /> girls, average length of time each girl would live at the home, type of supervision, and backup
<br />e counseling service provided by the Juvenile Department. It was explained again that upon complaint
<br /> of three neighbors living within 200 feet of the home the Planning Commission would review the
<br /> operation.
<br /> Edith Maddron, with the Juvenile Advisory Council to the Circuit Court, said the Advisory Council
<br /> favors the group foster home concept and that it is working very well across the country. She said
<br /> the individual group homes have proven the best way of combatting juvenile delinquency.
<br /> Dr. Purdy moved seconded by Mr. Anderson to uphold the Planning Commission in its granting of the con-
<br /> ditional use permit for a group foster home for girls at 1935 Valhalla Street, subject to:
<br /> (1) Review of the permit by the Planning Commission upon receipt of three formal,
<br /> written complaints from neighbors living within 200 feet of the property;
<br /> (2) No more than eight girls in residence, except on a short-term basis, when no
<br /> more than ten girls would be housed;
<br /> (3) Maintenance of the property in a residential manner; and
<br />I (4) Retaining the garage for storage of automobiles and not converting it into
<br /> living quarters.
<br /> Councilman Lassen asked about maintenance of the property, and Mr. Droge said a caretaker will be pro-
<br /> vided. The City Manager explained the provision for group foster homes in the Zoning Ordinance and
<br /> said the Fire Code and Public Works requirements have been met.
<br /> A vote was taken on granting the permit, and motion carried unanimously.'.
<br />- Mayor Cone left the meeting and Council President Purdy assumed the Chair.
