20 e 1/8/68 The letter of protest from Mr. Gaskill was read. Mr. Gaskill was present and compared estimated costs published prior to annexation with actual cost. The 'error in the publication was explained. Mr. Gas- kill questioned assessments on property in the assessment area owned by Mayor Cone. Councilman Lassen said at the present time there is no access to the Mayor's property. Councilman Wingard asked for a report on the status of assessments levied against property belonging to Mayor Cone. I Motion carried unanimously, except Councilman Lassen abstaining, and the bill was read the second time by council bill number only. Mr. Lassen moved seconded by Mr. McNutt that the bill be read the :third time by council bill number only, with unanimous consent of the Council. I 3 Council Bill No. 8221 - Levying assessments for sanitary sewer in WS-67-3 (area in Pioneer Corners Subdivision, Westers Addition, and 'between Tomahawk Place Subdivision, Coburg Road, Pioneer Pike, and Pioneer Court), submitted and read the first time in full on November 27, 1967 and held over to this meeting to allow proper .notice of assessment to be given owners of affected properties, was brought back for consideration with one written protest from Carl Hintz, 2460 Pioneer Pike. e Mr. Lassen moved seconded by Mr. McNutt .that the bill be read the second time by council bill number only, with unanimous consent of the Council. The letter from Mr. Hintz was read objecting to the assessment against the entire lot rather than to a depth of 160 feet in view of the easement the Hintz's granted the City for the sewer. The City Manager reviewed the history of the assessment against the Hintz property and said the property is large enough to accommodate another building lot. He said if an adjustment is made in the assessment against this property, adjustments would have to be 'made against other lots in the area assessed ,in the same manner.
