<br />~ <br /> <br />54 <br /> <br />e <br /> <br />2/5/68 <br /> <br />ORDINANCES <br /> <br />1 Council Bill No. 8237 - Levying assessments for paving and sanitary sewer in Oxbow Subdivision, <br />was submitted and read the first time in full on January 8, 1968 and held over to this meeting to. allow <br />proper notice of assessment to be given owners of affected properties, was brought back for consideration <br />with no written protests on file. <br /> <br />I <br /> <br />Mrs.Lau~~s moved seconded by Mr. McDonald that the bill be read the second time by couricil'bill number <br />only, with unanimous consent of the Council.' Motion carried unanimously and the bill was read the <br />second time by council bill number only. <br /> <br />Mrs.Launts moved seconded by Mr. McDonald that the bill be read the third time by council bill number <br />only, with unanimous consent of the Council. Motion carried unanimously and the bill was read the <br />third time by council bill number only. <br /> <br />Mrs.Lauris moved seconded by Mr. McDonald that the bill be approved and given final passage. Rollcall <br />vote. All councilmen present voting aye, the bill was declared passed and numbered 15068. <br /> <br />2 Council Bill No. 8238 - Levying assessments for paving Cleveland from Cross to Roosevelt, and <br />sanitary sewer within 160 feet of east and west margins of Cleveland from Roosevelt to Cross, was <br />submitted and read the first time in full on January 8, 1968 and held over to this' meeting to "allow <br />proper notice of assessment to be given owners of affected properties, was brought back for consideration <br />with no written protests on file. <br /> <br />e <br /> <br />Lawrence Hall, 150 North Cleveland, speaking for the property owner Mrs. Edna Schneider, said a <br />concrete driveway at this address was removed in the process of paving the street and replaced with <br />crushed rock. The Public Works Director said the driveway was installed before the area was annexed to <br />the City and projected into the street right-of-way. The County does not establish grade so the <br />driveway will not meet the street grade. He said if the concrete driveway is replaced it will have to be <br />a direct cost against the property and not assessed as a part of the whole project. <br /> <br />I <br /> <br />The City Manager explained the City's present policy when a grade variance exists is to take out the <br />driveway to a point where a proper grade can be established, then fill with rock and leave it to the <br />property owner as to the type surface he wants. He suggested the Council look at the property in <br />question before determining whether to replace the driveway, and said any determination would not affect <br />the assessment. It was understood the Council would look at the property on tour with regard to the <br />driveway. <br /> <br />Mrs. Lauris moved seconded by Mr. McDonald that the bill be read the second time by council bill number <br />only, with unanimous consent .of the Council.
