She <br />asked if the Council was aware that when the property in question was zoned RG it was expressly <br />understood there would be no access to Pearl Street. <br /> <br />The Traffic Engineer said that he was neither recommending nor objecting to the access, but if it is <br />permitted it should have maximum design to permit the least interference with traffic flow. <br /> <br />Otto Poticha said that not until planned unit development <br />ordinance were the owners able to develop this property. <br />staff level as required by the ordinance, he said it was <br />on Wi11amette if an access were provided from Pearl. <br /> <br />was provided for under the new zoning <br />In working out the development at the <br />agreed traffic problems would be alleviated <br /> <br />The PlanningDirector said the staff knew the property would be developed as PUD, but a policy deci- <br />sion by the Council on the Pearl Street access is necessary before the Planning Commission will con- <br />sider the development. <br /> <br />Dr. Purdy moved to refer the item to the Planning Commission for comments as to whether the stipula- <br />tion was made that there would be no access from Pearl Street if the property was rezoned RG. <br />Mr. Wingard said he would second the motion if it was the idea to protect the original intent of <br />limited access. <br /> <br />Councilwoman Hayward entered the meeting. <br /> <br />Councilman Anderson said he felt the motion should be to refer the policy of allowing access to <br />Pearl Street to the Planning Commission rather than this particular situation, and Mr. Wingard said <br />he would second such a motion. Mr. Anderson said he felt this particular access should be decided <br />now so the developers would know whether to proceed with plans. <br /> <br />Mr. Lassen seconded Dr. Purdy's motion to refer as stated. That motion was defeated, Councilman <br />Purdy, McNutl; and Lassen voting yes; Councilmen Lauris, Anderson, Hayward, McDonald, and Wingard <br />voting no. <br /> <br />Mr. Wingard moved seconded by Mr. Lassen to amend the original motion to refer the item to the Plan- <br />ning Commission, with the Council's approval of the overall plan. Motion carried, Councilman McDonald <br />voting no. <br /> <br />A vote was taken on the original motion as amended, and motion as amended carried unanimously. <br /> <br />The Public Works Director told the Council that action taken by a previous Council on a similar <br />request for this property allowed the owner to use a portion of the right-of-way between the curb <br />and the property line to build a frontage road. <br /> <br />1 <br /> <br />15. Jury Fee and Court-appointed Attorney - The City Attorney reported on the request of <br />Jon Shumate for waiver of the $30.00 jury fee and for a court-appointed attorney <br />in his appearance on a charge of receiving and concealing stolen property. Both re- <br />quests were denied by the Municipal Judge, and Attorney Ed Fadeley has appealed the <br />case to circuit court on behalf of Mr. Shumate. The City Attorney said the decision <br />ona similar case now pending in the Oregon Supreme Court will govern the City's <br />responsibility in this case. He said funds should be budgeted to cover expense of a <br />part-time public defender in the event the Supreme Court decision is to allow jury <br />trials for indigent persons without payment of the required fee. Councilman Anderson <br />suggested the possibility of working with the Lane County Bar Association in their <br />public defender program. It was understood the City Attorney would recommend an <br />amount to be budgeted for such purposes at the public hearing on the 1968-69 budget. <br /> <br />2 <br /> <br />16. Alcoholism Committee - The City Manager suggested appointment of a committee comprised <br />of one councilman and two lay people to work with Buckley House and the Lane County <br />Council on Alcoholism on development of an overall program to prevent overlapping of <br />services for which the City has budgeted funds. It was understood the Mayor would <br />appoint such a committee." <br /> <br />Mr. Anderson moved seconded by Mr. Lassen that Items 15 and 16 of the Committee report. Motion carried. <br /> <br />Committee meeting held May 23,1968: <br /> <br />"Present: Mayor Cone; Councilmen Anderson, Lauris, Purdy, Lassen, Hayward, and <br />Wingard; City Manager and staff; and others. <br /> <br />3 <br /> <br />1. Appointments, Mechanical Board <br />newly created Mechanical Board <br />functions as an appeal board. <br /> <br />- Mayor Cone announced the names of appointees <br />which replaces the existing Gas Advisory Board <br />Those appointed were: <br /> <br />to the <br />and <br /> <br />James Balzhiser, 3232 Bryceler Drive, for the term ending January 1, 1970 <br />Walter H.
