<br /> ,"" 37~ <br /> . <br /> 9/9/68 <br /> 1 Council Bill No. 8602 - Levying assessments for sidewalk on the west side of Pearl Street between <br /> . 5th and 6th Avenues (656 Pearl Street), submitted and read the first time in full on August 26, 1968 <br /> and held over to this meeting to allow proper notice of assessment to be given, was brought back for <br /> consideration with no written protests on file. <br /> Mr. Lassen moved seconded by Mrs. Lauris that the bill be read the second time by council bill number <br /> only, with unanimous consent of the Council. Motion carried unanimously and the bill was read the <br /> second time by council bill number only. <br /> Mr. Lassen moved seconded by Mrs. Lauris that the bill be read the third time by council bill number <br /> only, with unanimous consent of the Council. Motion carried unanimously and the bill was read the <br /> third time by council bill number only. <br /> Mr. Lassen moved seconded by Mrs. Lauris that the bill be approved and given final passage. Rollcall <br /> vote. All councilmen present voting aye, the bill was declared passed and numbered 15422. <br /> 2 Council Bill No. 8603 - Levying assessments for sanitary sewer along Tax Lot 4800 from Whitbeck <br /> . Boulevard to the north, submitted and read the first time in full on August 26, 1968 and held over to <br /> this meeting to allow proper notice of assessment to be given owners of affected properties, was <br /> brought back for consideration with no written protestson file. <br /> Mr. Lassen moved seconded by Mrs. Lauris that the bill be read the second time by council bill number <br /> only, with unanimous consentof the Council. Motion carried unanimously and the bill was read the <br /> . second time by council bill number only. <br /> . Mr. Lassen moved seconded by Mrs. Lauris that the bill be read the third time by council bill number <br /> only, with unanimous consent of the Council. All councilmen present voting aye, the bill was declared passed and numbered 15423. <br /> 3 Mayor Cone returned to the meeting and assumed the Chair. <br /> Council Bill No. 8595 - Vacating portions of Arthur, Cleveland, and City View Streets, submitted <br /> and read the first time in full on August 26, 1968 and held over to this meeting pending opinion with <br /> regard to legal sufficiency of petition opposing the vacation, was brought back for constEration. <br /> . A memo was read giving the opinion that the petition previously presented by Mr. Chrysler was not <br /> legally sufficient. The percentage of properties abutting City View Street and opposing the vacation <br /> was not large enough. A letter was read from Robert Elfers reiterating his previous arguments favor- <br /> ing the street's vacation. <br /> Dr. Donald Slocum said the opinion was in error with regard to the percentage of property abutting <br /> City View Street, since property for which he is trustee lies within 400 feet of the street's terminus <br /> on the south and he opposes the vacation. <br /> The Planning Director explained plans for the area and said legal access could be retained for the <br /> Konnie property by not vacating Arthur Street south of 29th Avenue. <br /> . Mr. Lassen moved seconded by Mrs. Lauris to amend the council bill to vacate only the portion of Arthur <br /> Street north of 29th Avenue. <br /> It was pointed out that the Chrysler property, if the council bill under discussion is adopted, would <br /> still have legal access by way of City View Street to Shields Avenue. Councilman McDonald asked why <br /> City View Street was realigned to the west instead of going straight south to connect at Shields, and <br /> IT the Planning Director explained that it was determined a better grade could be obtained. by the new <br /> alignment. Discussion continued on comparative grades of the two alignments, Eugene Water & Electric <br /> Board easements, and plans for future streets when property to the south is developed. <br /> Roger Chrysler reviewed the history of the street vacations under discussion and urged the Council to <br /> protect the City View right-of-way. Sam Konnie urged retention of access to his property south of <br /> Arthur Stree~ and the City View right-of-way. <br /> . <br /> Mr. McDonald moved seconded by Mr.Teague to amend the council bill by deleting the vacation of City <br /> View north of Shields Avenue. <br /> Robert Miles mentioned the effect of denying the City View vacation on setbacks along that street <br /> where homes have been built on the basis of owning property to the centerline of the City View right- <br /> of-way. <br /> . <br /> A vote was taken on the second amendment, retaining the City View right-of-way, and motion carried, <br /> Mr. Lassen voting no. <br /> t <br /> A vote was taken on the first amendment, retaining Arthur Street right-of-way south of 29th, and <br /> motion carried. <br /> Mr. Anderson moved seconded by Mr. Lassen to read the council bill as amended the second time by <br /> council bill number only, with unanimous consent of the Council.
