<br />t <br /> <br />I - <br /> <br /> <br />, <br /> <br />I <br /> <br /> <br />'.- <br /> <br />~ <br />1:'{. <br /> <br />2/3/69 <br /> <br />There was considerable discussion, with the consensus being that a committee of <br />the Council could be formed to sit with the Bureau of Governmental Research to <br />evolve a policy and direction in updating not only the criminal code, but the <br />balance of the City code. For a broad attitude in suggesting policy, such a committee <br />could include attorneys, someone from the judicial field arid prosecuting field', a repre- <br />sentative of the police department and others. <br /> <br />Mrs. Jane Novick, 3960 Blanton Road, read a statement in which she pointed out that care <br />should be taken to protect the right of individuals,'and that such an ordinance should <br />be framed in such a way that it could not be used to harass people we don't ,like, or those <br />who offend us visually, and who are otherwise committing no offense. She also advocated <br />that the city provide public places where loitering is permit-eed"arld even encouraged. <br /> <br />In answer to a question from Mr. Teague, Mr. Hendershott pointed out that the proposed <br />ordinance concerns a question of loitering under unusual circumstances. <br /> <br />Mrs. Beal asked for information on coming State legislation. Mayor Anderson pointed out <br />that the Chamber of Commerce has a series of luncheon sessions every other Saturday <br />beginning February 15th concerning legislative sessions, ana,he';s).1gg'ested that the' Council <br />have a representative at these meetings. The City Manager said that the League of Oregon <br />Cities publishes a weekly newsletter to keep members informed of ' new legislation, and that <br />this bulletin will be on file in the Manager's office for the convenience of Council members. <br /> <br />The Planning Director commented that several people from Community Goals Conference have <br />offered to participate in legislative activities ,in various ways. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald to receive and file. Motion carried. <br /> <br />After a discussion of the motions involved and appointment of a committee, the Attorney stated <br />that Councilman Mohr had furnished a brief to both his office and that of the 'Police Dep- <br />artment requesting information about this ordinance. The Attorney requested postponement <br />for further study. Councilman McDonald deplored the lengthy delay, and asked that this <br />matter be scheduled for a work session as soon as possible. <br /> <br />A vote was taken on the motion as stated and .the motion carried. <br /> <br />1 <br /> <br />e. 10th and Oak Parking Structure - The City Manager commented on the problem of getting <br />possession of two spaces in the 10th and Oak parking district site. The tenants maintain <br />that they did not receive proper notice, and wish to remain until the Urban Renewal Contract <br />is signed, as this would enable them to receive benefits to cover the cost of the move. The <br />Manager said that he had tried to be considerate in not setting an eviction date when tenants <br />must vacate, and that the City is now faced with a delay. RathertIDRart' Jeopardize comple- <br />tion of the project by the deadline, the City has made arrangements-for a monetary con- <br />sideration, and the tenants have agreed to move without delay. <br /> <br />Mrs. Hayward moved seconded by Dr. Purdy to receive and file. <br /> <br />The City Manager explained to ,the Council that, to expedite removal of structures, the amount <br />of $3,000 had been paid to Eugene Blue Print and $4,650 to Martinizing Co. <br /> <br />A vote was taken on the motion as stated and the motion carried. <br /> <br />2 <br /> <br />2. City Holidgy Policy.- The Manager recommended that the Friday,following Thanksgiving and a <br />holiday to be taken at employees convenience, be substituted for holidays now taken on <br />Lincoln's and Washington's birthday. This would eliminate one' day of closure of City Hall <br />at a time when other businesses are customarily open. <br /> <br />Dr. Purdy JIloveddseconded by ~,: Mohr to approve the recommendation. Motion carried. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald to receive and file. Motion carried. <br /> <br />3 3. Planning Commission Report - December 23, 1968 <br />a. Vacation, 18th Avenue between Oakpatch Road and 19th Avenue, Bierly -jThe Planning <br />Commission recommended the vacation, since realignment of 18th Avenue eliminated the <br />need for right of way. Vacation would take the property out of public ownership. <br /> <br />Dr. Purdy expressed concern that vacation of. this property could create a lot of sufficient <br />size for construction of a house. The Planning Director assured him that this could not <br />be done without subdivision, and, an ,approved subdivision could not be created if it did <br />not meet requirements of the subdivision ordinance. <br /> <br />Dr. Purdy moved seconded by Mrs. Hayward to approve the recommendation of the Planning <br />Commission. Motion carried. <br /> <br />Mrs. Hayward moved seconded by Dr. Purdy to approve Item 3b,of the Committee report. <br /> <br />Dr. Purdy still was concerned about Lot 6400' and its possible subdivision. 1l11elPl.9.nning <br />Director again assured him that proper subdivision was assured by the subdivision ordinance <br />and said that this lot had previously had, legal access. <br /> <br />A vote was taken on the motion as stated and the motion carried. <br /> <br />2/3/69 - 2 <br /> <br />.... <br />
