All councilmen present voting aye, the bill was declared passed and numbered 15555. <br /> <br />'I <br /> <br />3 Council Bill No. 8738 - Levying assessments for P?~ing and sidewalk on Chambers Street from 24th <br />Avenue to McLean Boulevard, was submitted and read the first time in full on February 24, 1969 and held <br />bver to this meeting to allow proper notice of assessment to be given owners of affecged properties, and :: <br />, <br />was brought back for consideration with written protests on file. ' <br />:l <br /> <br />Mr. Henry Camerot, attorney for the developer of property between Chambers and Filmore, said the developet' <br />had petitioned the Planning Commission to allow one lot to front on Chambers. This plan was opposed; , <br />and it was suggested by the Planning Commission that all lots front on, Filmore. Since these lots back <br />up to Chambers, the developer objects to paying assessments, when he has no egress. 'Mr. Camerot circu- <br />lated photographs and explained that the lots could not' utilize Chambers Street. Council asked who had <br />puilt the earth burm on the rear of these lots. Director of Public Works said, to his knowle~ge, <br />Breeden Bros. had built this mound. Attorney advised Council in his memo of March 10th that the City' <br />~ould legally make an assessment 'upon the property 2wners whose lots abutted Chambers for their propor- <br />tionate share of the cost of improvement. <br /> <br />Mr. Earl Eggers, 2105 West 29th, explained that his property has only 25' fronting on Chambers Street; <br />and that he would not, at any time, take advantage of sanitary sewer service off Chambers Street. He <br />pbjects to paying the sewer portion of the assessment. Director of Public Works said a stub was put <br />in as a matter of policy. <br /> <br />;, <br /> <br />Councilman Mohr .moved that the Council amend Council Bili 8738 to recognize lots on Chambers Street <br />derive from use of sidewalk and should be assessed, but Council finds no benefit derives from abutting <br />street, and that assessment be made only on sidewalk.
