<br /> I Mr. Al Pierce, 2515 Terrace View, explained that the ditch in question was 12 feet deep. by 52 feet
<br /> wide, and that he had thirteen lots facing the proposed location. He felt this construction would
<br /> devalue these lots $1,000 ,each.
<br /> City Manager explained .that the requested right of way is only a small portion of this length. Mr.
<br /> Pierce agreed that the City was only taking 400 feet of land, but he would have about 1,000 feet
<br /> against the ditch. Manager said Pierce property wou~d be in same position as property along West
<br /> Belt Line and property backing up against Amazon Ditch. If the City cannot negotiate to obtain
<br /> Pierce proper~yy,it will have to be settled in court. Staff is in no position to negotiate damage
<br /> question.
<br /> Mrs. Karen Lansdowne said she had signed an agreement, and at the time of signing had been told a letter
<br /> would be presented to the Council, along with the agreement. She said the City will betaking some
<br /> of her property for this first phase"- a strip 32 feet wide.
<br /> City Manager read a letter from Mrs. Lansdowne, and explained that the motion had to do only with
<br /> filing of. condemnation, which would no longer be necessary on her property, in view of the document
<br /> e agreed to that day. Mrs. Lansdowne's letter requested that the City review its policy'~nd further
<br /> provide adequate planting or screening adjacent to the channel in all construction.
<br /> Mr. Paul Lansdowne explained the properties in question, and that the one presently under discussion
<br /> belonged to his wife. His name should not be included.
<br /> Manager said question of screening will be put on future committee agenda, with a tour preceding.

<br /> Planning Commission Report, October 7, 1969:
<br /> 1. Amendment to Zoning Ordinance, Section 11.02 - having to do with sale of alcoholic beverages in
<br /> restaurants in C-l District - Manager explained that, at the present time, grocery stores in C-l
<br /> District are permitted to sell package beer, but a restaurant in the same district is not permitted
<br /> this pr i vilege. Planning Commission recommended deletion of word "not" from description of restaurant
<br /> as permit~ed in C-l Zone.
<br /> Mrs. Hayward moved seconded by Mr. McDonald t~ approve the recommendation of the Planning Commission in
<br /> regard to amendment of the zoning ordinance with regard to sale of alcoholic beverages in restaurants
<br /> in C-l District. . -. . . .
<br /> Councilman Wingard asked City Manager if C-l Zone was not Neighborhood Commercia1 and asked how many
<br /> sandwiches had to be sold to be considered a restaurant. He felt this should be kept a conditional
<br /> use, as he did not approve of taverns in residential districts. Planning Director. said tavern,
<br /> lounges and bars are specifically mentioned in other zones and would not be permitted in a C-l Zone.
<br /> Mrs. Hayward indicated that OLCC has control over this, and what Planning Commission is really
<br /> trying to do is eliminate inconsistency in zoning ordinance.
<br /> Dr. Purdy moved seconded by Mrs. Hayward to place this item on the Agenda of November 5. Motion carried.
<br /> I ,2. Zone Changes recommended for approval:
<br /> I a. Pohll, O'Connor, Melevin, .Lyman, Coleman, Allen and .Lee - located east.side of Portland
<br /> Street between 29th Avenue and 30th Avenue. Recommended change from RA to RG-PD for
<br /> I apartments. Planning Commission recommended installation of traffic diverter because
<br /> of increased traffic. Approved only 20 units.
<br /> This request has been held several months pending. resolution of several problems, including
<br /> e increased traffic. The commercial activity at the intersection of 29th and Willamette
<br /> has made resid'ential development less desirable. Traffic Engineer recommended installation
<br /> of traffic barrier to prohibit north and south movement of traffic on Portland Street
<br /> between 29th Avenue and 29th Place. Planning Commission recommended RG , . PD wi th
<br /> control over number of apartments to be built... The Council should hold a public
<br /> hearing to allow residents to express sentiment over construction of cuI de sac.
<br /> Councilman Teague felt parking should be eliminated on Portland Street.,
<br /> Mr. Arthur Ruhndorf, representing. Cascade Manor, felt Portland Street was..too narrow,
<br /> and complained that no effort had been made to remove.parking. Dr. Purdy pointed out
<br /> that there is an existing problem of parking and sight obstruction created by Cascade
<br /> Manor.
<br /> Mr. Wally Swanson, l40.Coachman Drive, said many traffic problems were created by persons
<br /> I avoiding congestion at 29th and Willamette by traveling Portland Street as. far as Crest
<br /> .Drive. He felt the problem would be further aggravated hyclosing off.Port.land Street
<br /> to through traffic. Mr. Porter explained that a by-pass is planned for . this' inter-
<br /> section in the future. - . .,
<br /> Mr. Dave Mobley, 331 Portland Street, felt any more traffic would be hazardous to
<br /> residents and children. He was inagreement.with suggestion of ~ traffic barrier.
