Eugene Renewal Agency Request to Place Empty Conduit in Mall Area - Mr. Frank Shearer, <br />ERA member, explained that placement of conduit in the mall area might eliminate future <br />tearing up of pavement. A decision is necessary because it sh0uld be installed within <br />the next few days. <br /> <br />Mr. Dave Hunt explained a diagram of proposed underground conduit and what future uses <br />it could accommodate. <br /> <br />e <br /> <br />Mr. Mohr said he would be willing to consider approval of this request if a method of <br />control were proposed. Mr~ Hunt pointed out that this would be city property, and <br />permission would be required for any use after completion. <br /> <br />I <br />i <br />I <br />II <br />II <br />Ii <br />Ii <br />II <br />l' <br />II <br />II <br />II <br /> <br />Several Council members were concerned that this conduit would be used for amplifica- <br />tion of music or other loudspeaking systems in the mall, and were ,not in favor of any <br />noise generation. <br /> <br />Mr. Williams felt options shofuld be kept open, and that the expense of installing it <br />later would be tremendous. He moved, seconded by Dr. Purdy that a raceway be provided <br />in the mall as requested by Eugene Renewal Agency. <br /> <br />I <br /> <br />Mr. Williams explained that there was a difference between keeping an option and <br />installing a sound system. <br /> <br />Councilman Mohr asked if Mr. Williams would, as part of his motion, ask the City <br />Attorney to draw an ordinance specifying conditions for use of the raceway. <br /> <br />Mr. Williams said he would add to the motion that the City Attorney prepare a report <br />on legal title, controls over the conduit, and suggest any measures he might feel <br />appropriate to assure that control. <br /> <br />II <br />II <br />I <br />i <br />IJ <br /> <br />Dr. Purdy pointed out that what the Council was app~oving was expenditure of $1,000 <br />for a conduit, and:mot an expensive system. He said he would hate to bind a future <br />Council. <br /> <br />Public Works Director explained that installation of conduit at this time might <br />prevent ripping up the mall in the future. <br /> <br />In answer to Mrs. Hayward, City Attorney said the report would be ready at the next <br />regular meeting. <br /> <br />II <br />'I <br />II <br />Ii <br />II <br />r <br /> <br />I <br /> <br />I <br />I <br />I <br />t <br /> <br />It was decided to defer action until the regular meeting. <br /> <br />I <br /> <br />City Manager read a memorandum from the City Attorney which stated that the City'had the power to <br />install the conduit in the mall, and had control over any use made of that conduit. <br /> <br />Mr. Williams moved seconded by Dr. Purdy that the Council recommend t9 Eugene Renewal Agency that <br />the conduit be installed in the underground area for the use that might be ordained at some future <br />time by the Council. <br /> <br />,~ <br /> <br />Councilwoman Hayward felt that this was not really planning for the future at all. There had been <br />no indication of any use of this conduit other than some kind of noise. <br /> <br />There was further Council discussion on possible uses for conduit, and whether it should be installed <br />in the mail at this time. <br /> <br />Mr. Bob Harland felt there might be a need for some type electrical system in the future in the mall. <br /> <br />Mr. Alan Seder felt the Council should plan now so that there would never be a sound system in the <br />mall. <br /> <br />Mr. Leonard Nicola, 1954 Grant, was in favor of installation of conduit ,'and felt it might prevent <br />tearing up the mall in the future. <br /> <br />I <br /> <br />I <br />I <br />II <br /> <br />I! <br />:1 <br />I <br />I <br />I <br />I <br />I <br />~' <br /> <br />There was Council discussion about limiting uses of this conduit, and it was pointed out that future <br />Councils could decide on permitted uses after such uses were proposed. <br /> <br />Vote taken on motion. Messrs. Williams, Teague and Purdy voted in favor. Mrs. Hayward, Mrs. Beal <br />and Mr. Mohr voted against the motion. Mayor Anderson voted in favor. Motion passed. <br /> <br />Mayor Anderson said he felt future Councils would find noise just as objectionable as this Council. <br />He would hate to see jack hammers tearing up concrete. Future Councils would be able to designate <br /> <br />standards and refinements of requests. <br /> <br />e <br /> <br />5/25/70 - 5 <br />
