Mr. Fairchild accepted the award, and said his business was one capable of :1 <br />I: utilizing the handicapped, and he had found them very helpful. <br /> <br />I, Mr. McDonald moved seconded by Mr. Teague to receive and file Item IC of the Committee report. <br />Motion carried. <br /> <br />II. Brown Concession; Mall Plaza - At the July 27 Council meeting the Council approved the <br />concept of a small concession in the block on Broadway between Willamette and Olive. <br />A petition has been received from five businesses in the vicinity asking for recon- <br />sideration. <br /> <br />, Dr. Purdy suggested the Mall Activities Committee look into this matter. Mayor Ander- <br />son was unsure whether this was the type of thing that committee would be concerned <br />:: with. The committee will recommend guidelines for activities which the mall provides. <br />I, <br />Mr. Dave Hunt, Eugene Renewal Agency, agreed with Mayor Anderson. He reminded the <br />A ~I Council that this matter had been before them in July because the contractor was about <br />~ to pour concrete, and it was necessary to install plumbing and conduit ,if such uses <br />were to be permitted. There has been no agreement with Mr. Brown whether or not he <br />will actually want his stand in this location. <br /> <br />" There was discussion whether or not Mr. Brown actually wanted to locate on this spot. <br />: When questioned, Mr. Brown said he was concerned how much the rent would be. Mr. <br />I Hunt explained that there were many factors to consider, and that the Council would <br />!, have to app~Qve any agreement. There are legal problems involved. <br /> <br />M~s. Hayward felt the question was really what Council policy would be concerning <br />location of businesses in the Mall. The City Attorney explained that there are legal <br />problems with location of businesses in City property, especially since abutting <br />businesses have objected. <br /> <br />Councilman Williams suggested the City Attorney continue research on this question, <br />i and in the event he finds the Council is not authorized to grant this permission, he <br />draft legislation to submit to the legislature which would give City's this right. <br /> <br />Mayor Anderson suggested that the Renewal Agency might take the responsibility to <br />get this matter through the legislature. <br />:; <br /> <br />Mayor Anderson said no action would be taken on this petition until legal clarifi- <br />cation was obtained as to uses of the Mall by commercial operations. <br /> <br />" Mr. Hunt said the Renewal Agency could work out some agreement with Mr. Brown <br />concerning a lease, and would bring it to the Council for approval. <br /> <br /> <br />Mayor ffiderson suggested the petition be placed on file until a final determination <br />is made on the agreement. <br /> <br />III Dr. Purdy requested that ownership of abutting property be determined. <br /> <br />Mr. Gerald Fields, owner of the Little King Sandwich Shop, asked the City to consider <br />types of business and possible conflict. He pointed out that 25% of his business is <br />soft drinks and coffee, and that Mr. Brown sells the same thing.' <br /> <br />, Mayor Anderson said the matter will be brought back for further consideration when the <br />e " legal problems have been clarified. <br /> <br />Mr. McDonald moved seconded by Mr. Teague to receive and file Item II of the Committee report. <br />Motion carried. <br /> <br />I <br />: III. Council Procedures, Report - Councilman McDonald said the Council subcommittee appointed <br />, by the Mayor had suggested agenda reorganization and a recommendation on procedure <br />for filling committee vacancies. <br /> <br />Mr. Williams said recommendations had been made regarding format of Council and <br />Committee agendas. <br /> <br />Mrs. Beal commented items from the Council and Mayor should still be included, <br />, unless they involve a presentation. It was agreed that this procedure would be <br />:: followed. <br /> <br />I Councilwoman Hayward said this report had clarified appointment procedures, but <br />she hoped it would not preclude appointment of Councilmen in the way the Council <br />had acted in filling the last vacancy on the Council. It was explained that <br />:1 this report did not set out hard and fast rules for council action, and that this <br />same policy could be followed if the Council wished to do so. <br /> <br />Dr. Pur9Y suggested an amendment to the Resolution setting out by-laws to incorporate <br />suggestions in the report. ' , <br /> <br />4IJ There was discussion regarding expense allowances, and whether Councilmen should be. <br />allowed a set fee for expenses.
