This problem should be faced along with the need for <br />routes. Mr. Drapela said a subcommittee of the ,'bicycle committee has been formed to study <br />bicycle laws and emphasize safety, and proposed community education programs. Purchase of the property at this time is desirable to pro- <br />tect against future problems, especially those involving purchase of developed property. The <br />owners propose to build a building on the south portion of their property for manufacture of <br />merchandise. They have discussed the matter with the city so they would not be faced with <br />possible removal of their building when the expressway was constructed. Negotiations have <br />continued for several months with no agreement reached. The staff has recommended the matter <br />be taken to condemnation. <br /> <br />Mrs. Donald Ridenour gave the Council a history of acquisiton of a portion of their propert~ <br />for construction of the Amazon Channel, and their negotiations with city staff for purchase <br />for right of way for the Amazon Expressway. She explained operation of their business and <br />Jheir need for the ground which the city has offered to purchase. She quoted prices received <br />for neighboring properties as a basis for their request for $5,000 to be paid for the ground <br />needed for the right of way. She answered Councilmen's questions regarding her, property, <br />and her refusal to accept the City's offer of $3,500. <br /> <br />Mayor Anderson assured Mr. and Mrs. Ridenour that the Council appreciated their position and <br />respected it, but also recognized that there are many possibilities for dispute, in view of <br />the background of the situation. He explained that there are countless disputes of this <br />nature and that they are generally left to the court for arbitration and that the Council <br />could set a dangerous precedent by entering into disputes over, the value of property or <br />matters of arbitration. Condemnation proceedings have been set up for this very reason, and <br />are properly a matter for court resolution. The Council is not a proper place to resolve <br />questions of fact and questions of :value. <br /> <br />After further discussion Mr. Gribskov moved seconded by Mrs. Beal that the City Manager be <br />authorized to proceed with condemnation proceedings.' Motion carried. approve <br /> <br />Announcement of Resignation of Brian Obie and Appointment of New Commissioner Wi thin Two Weeks, <br />Mayor Anderson formally announced the resignation of Brian Obie from,the Planning Commission <br />and stated that he would have a new appointment for that Commission within the next two weeks. <br /> <br />Law Enforcement for Bicycle Riders Safety. Support for State Legislation Regarding Bicycle <br />Trails - Councilman Gribskov raised the question of publicity for bicycle safety, tg which <br />the City Manager replied his staff will be directed to' inves i;,i gate avenues for providing such <br />publicity, since the safety of Eugene's bicycle riders is a growing concern. Mr. Drapela, <br />Assistant Parks & Recreation Department Director, reported that the subcommittee of the <br />Bicycle Committee, comprised of two staff and two lay people, is currently studying the <br />problem and its intention is to provide guidelines for a safety education program for the <br />residents of Eugene. There are three proposed bicycle routes now before the subcommittee, <br />which holds its next meeting March 11th. This meeting should result in submission of a <br />proposal of at least one of these routes. <br /> <br />Mrs. Campbell requested that Andy Jordan, Legislative Assistant, look into the implications <br />of two bills currently dealing with bicycle safety, HB~1700 and SB 126.
