2005 Legislative Session IGR Commitee Bill Approval May 23, 2005 <br />Prohibits Land Conservation and Development Commission and Department of Land <br />Conservation and Development from taking any action against local government by reason of <br />modification of, removal of or failure to apply land use regulation in response to claim under <br />Ballot Measure 37 (2004). Prohibits civil action by other property owners to recover loss of <br />value to property that is claimed to have occurred by reason of modification of, removal of or <br />failure to apply land use regulation in response to claim under Ballot Measure 37 (2004). <br /> HB 3120 1 Oppose Declares emergency, effective on passage. 5/05 <br /> Requires applicant for energy facility site certificate to obtain land use approval from local <br /> government. Requires State Department of Energy to generate environmental impact <br /> statement. Allows site certificate to be granted only if applicant can show need for generating <br /> HB 3135 1 Support capacity. Requires disclosure of financial ability and criminal history by applicant. 3/31 <br /> Abolishes local government boundary commission having jurisdiction in Lane County and <br /> Lane County Local Government Boundary Commission Fund. Transfers moneys in fund to <br /> HB 3265 1 Oppose Lane County for specified purposes. 3/24 <br /> Authorizes formation of county service districts with overlapping jurisdiction if districts are <br /> authorized to provide different services. Expands purposes for which county service district <br /> may be formed within jurisdiction of local boundary commission. Limits authority of city or <br /> HB 3301 1 Oppose special district to object to formation of county service district. 3/24 <br /> Allows Governor to waive land use statutes, goals and regulations if Governor finds existence <br /> HB 3314 1 Oppose of economic emergency. 4/21 <br /> Authorizes retention of replaced dwelling on land zoned for forest use or mixed farm and forest <br /> use if dwelling is needed for labor intensive animal husbandry activity or for use by elderly or <br /> HB 3401 1 Oppose disabled family member. 4/21 <br /> Proposes amendment to Oregon Constitution to modify double majority voting requirements in <br /> property tax elections so that double majority requirement does not apply to local property tax <br /> measures submitted to electors in elections in May or November of any year. Refers proposed <br /> amendment to people for their approval or rejection at special election held on same date as <br /> H JR 0014 1 Support next primary election. 4/07 <br /> Proposes revision to Oregon Constitution that directs Legislative Assembly to provide for <br /> establishment of general system of public schools. Directs Legislative Assembly to appropriate <br /> sufficient moneys to provide basic education to each child in public school. Allows school <br /> districts to provide education services that are in addition to basic education. Limits amount <br /> expended by each school district to total amount necessary to provide quality education. <br /> Directs Legislative Assembly to define basic education and quality education. Permits school <br /> districts to impose property taxes outside of existing constitutional property tax limitation, if <br /> taxes are approved by majority vote of district voters. Limits total amount of district property <br /> taxes to amounts needed for quality education.
