2005 Legislative Session IGR Commitee Bill Approval May 23, 2005 <br /> <br /> Creates sunset provision for all personal income or corporate excise or income tax <br /> expenditures that are not required under federal law, Oregon Constitution or to avoid double <br /> HB 3149 2 Support taxation. Creates Oregon Tax Expenditure Commission. 4/21 <br /> Deletes provision requiring Land Use Board of Appeals to affirm local government's <br /> interpretation of local government's comprehensive plan and land use regulations unless <br /> interpretation is inconsistent with express language of, purpose for or underlying policy of plan <br /> HB 3202 2 Oppose or regulation or is contrary to statute, goal or rule that plan or regulation implements. 4/21 <br /> Establishes fee on gross receipts derived from short-term vehicle rental operations. Transfers <br /> net fee revenues to State Police Account. Applies to gross receipts from short-term vehicle <br /> HB 3217 2 Oppose rentals occurring on or after January 1, 2006. 4/07 <br /> Requires that, when public entity removes, modifies or does not apply land use regulation in <br /> lieu of paying just compensation under Ballot Measure 37 (2004), public entity's action is <br /> ~ersonal to claimant. Extinguishes removal, modification or nonapplication of land use <br /> HB 3220 2 Support regulation after three years. Authorizes issuance of supplemental judgment, if <br /> original judgment is not satisfied within two years after date claim for compensation accrued, <br /> that allows claimant to use property for purpose for which claimant could use property when <br /> HB 3241 2 Oppose acquired. Declares emergency, effective on passage. 4/21 <br /> Requires public entity that receives claim for compensation under Ballot Measure 37 (2004) to <br /> conduct public hearing prior to making final decision on resolution of claim. Requires public <br /> entity to provide notice at least 90 days prior to final hearing relating to claim by first class mail <br /> to owners of property within 300 yards of property for which compensation is claimed. Declares <br /> HB 3242 2 Oppose emergency, effective on passage. 4/21 <br /> Declares that decision of public entity to resolve claim for compensation for land use <br /> regulation that purportedly restricts use of private real property and reduces fair market value of <br /> property is not land use decision or limited land use decision and is not subject to jurisdiction of <br /> Land Use Board of Appeals. Establishes necessary parties and interested parties to resolution, <br /> by public entity or by court, of claim for compensation.
