2005 Legislative Session IGR Commitee Bill Approval May 23, 2005 <br /> <br /> Requires that, when public entity authorizes use of land by removing, modifying or not applying <br /> land use regulation in lieu of paying compensation under Ballot Measure 37 (2004), waiver of <br /> land use regulation is extinguished when property is developed pursuant to waiver. Declares <br /> development use created pursuant to waiver to be statutorily conforming use that is <br /> maintained, improved, replaced or transferred in same manner as comparable use established <br /> HB 3244 2 Monitor without reference to Ballot Measure 37 (2004). Declares emergency, effective on passage. 4/21 <br /> Prohibits transfer of claimant's interest in judgment entered in action under Ballot Measure 37 <br /> (2004), to anyone other than family member of claimant. Declares emergency, effective on <br /> HB 3245 2 Support ~assage. 4/21 <br /> Requires owner of private real property claiming compensation under Ballot Measure 37 <br /> (2004), for land use regulation that purportedly restricts use of property and reduces fair market <br /> value of property, to include appraisal of property in written demand claiming compensation. <br /> Delays start of 180-day or more period after which compensation becomes due and cause of <br /> action may be filed until written demand is completed by submission of appraisal. Declares <br /> HB 3246 2 Support emergency, effective on passage. 4/21 <br /> Requires owner of private real property who makes written demand under Ballot Measure 37 <br /> (2004), for just compensation for land use regulation that purportedly restricts use of property <br /> and reduces fair market value of property, to provide title report or abstract identifying all <br /> owners of property for which claim is made. Requires that all owners be joined in proceedings <br /> with public entity or in cause of action to resolve claim. Declares emergency, effective on <br /> HB 3247 2 Support passage. 4/21 <br /> Requires public entity that receives claim for compensation under Ballot Measure 37 (2004) to <br /> review written demand for completeness and conformity to requirements of Ballot Measure 37 <br /> (2004) before paying compensation or granting compensation exception. Requires public entity <br /> to conduct public hearing prior to making final decision on resolution of claim. Declares <br /> HB 3248 2 Oppose emergency, effective on passage. 4/21 <br /> Requires public entity that receives claim for compensation under Ballot Measure 37 (2004) to <br /> conduct one or more public hearings prior to making final decision on resolution of claim. <br /> Authorizes review of final decision of public entity by circuit court by writ of review. Prohibits <br /> HB 3249 2 Oppose review by Land Use Board of Appeals. Declares emergency, effective on passage. 4/21 <br /> Authorizes existing county service district to undertake construction, maintenance and <br /> HB 3250 2 Oppose operation of up to five types of service facilities without initiating new formation proceeding. 4/21 <br /> Imposes tax on purchase price of luxury items. Directs Department of Revenue to deposit <br /> moneys in accounts for kindergarten through grade 12 education, community colleges and <br /> state institutions of higher education. Establishes Higher Education Support Fund. Continuously <br /> appropriates moneys in fund to State Board of Higher Education. Applies to retail sales of <br /> HB 3254 2 Support luxury items made on or after January 1,2006. 4/21 <br /> 20 <br /> <br /> <br />
