2005 Legislative Session IGR Commitee Bill Approval May 23, 2005 <br /> <br /> Provides immunity under certain circumstances for person reporting possession of or <br /> transaction involving precursor substance. Creates crime of distribution of equipment, solvent, <br /> reagent or precursor substance with intent to facilitate manufacture of controlled substance. <br /> Punishes by maximum of 10 years' imprisonment, $250,000 fine, or both. Creates crime of <br /> unlawful possession of lithium metal or sodium metal. Punishes by maximum of one year's <br /> imprisonment, $6,250 fine, or both. Expands crime of theft in first degree to include theft of <br /> precursor substances. Authorizes State Board of Pharmacy to adopt rules regulating sale or <br /> transfer of products containing pseudoephedrine. Punishes failure to make, keep or forward <br /> records by one year's imprisonment, $6,250 fine, or both. Modifies recording requirements for <br /> transactions involving iodine in elemental form or iodine matrix. Increases punishment for <br /> failing to comply with recording requirements to maximum of one year's imprisonment, $6,250 <br /> SB 0912 2 Support fine, or both. Requires State Fire Marshal to determine whether <br /> cigarette variety meets standard for fire-safe cigarettes. Requires State Fire Marshal to publish <br /> and distribute list of fire-safe cigarettes beginning no later than January 1, 2006. Prohibits <br /> distribution or offer to sell cigarette unless cigarette is of variety State Fire Marshal has <br /> determined to be fire-safe cigarette. Makes violation by person distributing or offering to sell <br /> cigarettes to wholesaler or retailer subject to civil penalty not to exceed greater of $10,000 or <br /> five times value of cigarettes. Makes civil penalty applicable to distributions or offers to sell <br /> occurring on or after March 1, 2006. Makes violations by person distributing or offering to sell to <br /> public subject to civil penalty not to exceed $500 for violation involving not more than 1,000 <br /> cigarettes and not to exceed greater of $1,000 or five times value of cigarettes for violation <br /> involving more than 1,000 cigarettes. Makes civil penalty applicable to distributions or offers to <br /> SB 0931 2 Support sell occurring on or after July 1, 2006. Prohibits cigarette packages or cartons that bear device 3/17 <br /> Provides that cities, counties and other political subdivisions may regulate only possession of <br /> SB 0957 2 Oppose firearms and ammunition in public places. 3/17 <br /> <br /> 32 <br /> <br /> <br />
