Mr. Chapman said the next State Legislature will probably review annexation laws and annexation laws are a ma i n issue in the replacement of State Representative Ron Eachus. He said Eugene should be very careful about e creating islands that can be annexed without residents' consent and River Road residents have reason to be apprehensive about annexation proposals. Mr. Chapman suggested Beltline Road east of Highway 99 be deleted from the proposal because there is no reason to annex the EWEB reservoir. He sa i d approval of the proposal as presented will damage relations between River Road residents and the City. During consideration of another annexation proposal, Vora Heintz, said her testimony during consideration of the Twelfth Street Development Corporation, et al (AZ 87-8) applies to this proposal also. Her testimony was: "Vora Heintz, 1038 Jayne Drive, said she is chairperson of the River Road Community Organization. She said she was not provided information about the annexation proposals in time to comment on them. The organization's next meeting will be November 9, 1987. She said Eugene has a policy of illogical extensions and creeping annexations that do not address cost effectiveness, law enforcement, or the right of citizens to vote on annexations. "Ms. Heintz said citizens also were not permitted to vote on sewers in the River Road area. She said development of the River Road/ Santa Clara Urban Facilities Plan by the CAT excluded participation of the River Road Community Organization. She said the community organization opposes the annexation proposals within and without the e organization's boundaries recognized by the Lane County Board of Commissioners. She specifically opposed the annexation of Beltl ine Road. She discussed State legislation concerning annexation procedures. "Ms. Heintz said the River Road Community Organization opposes all annexation proposals in the area. She requested that her testimony be included in the record of each proposal. II There being no additional requests to testify, Mayor Obie closed the public hearing. Mr. Lowe said Lane County rezoned many properties, including Mr. Smith's, in 1982 when the Metro Plan was adopted. Discussing the configuration of this proposal, he said nonconsenting property owners, such as the Johnsons, were included in the proposal to create the most effi ci ent serv ice de 1 i very boundary possible. Residential properties were excluded because residents might remonstrate. Part of Beltline Road was excluded to avoid encircling the River Road Area. Some nonconsenting property owners east of Prairie Road were included in the proposal because a fairly large area is needed to justify the construction of sanitary sewers. e MINUTES--Eugene City Council October 26, 1987 Page 8
