ORDINANCE CONCERNING NOISE DISTURBANCE (memo, ordinance distributed) <br /> e Assistant City Manager David Whitlow introduced the agenda item. Captain Bill <br /> DeForrest of the Eugene Police Department presented the staff report. He <br /> explained that the proposed ordinance was necessary to delete the present <br /> language prohibiting unreasonably loud or raucous noise which was found to be <br /> unconstitutional in that it did not provide adequate notice to the public of <br /> the prohibited behavior. He said the City Attorney's Office had researched <br /> the issue and had developed the proposed ordinance which was similar to <br /> ordinances of Salem and Portland which were held to be constitutional. <br /> Captain DeForrest stated that the fine proposed for violation of the ordinance <br /> would not exceed $500 and a maximum of 100 days in jail. He stressed that the <br /> Police Department did not have an effective enforcement tool to deal with <br /> numerous noise complaints within the community. Captain DeForrest felt that <br /> the proposed ordinance will provide the department with the means necessary to <br /> respond to the noise complaints. <br /> Councilor Ehrman commented that the proposed ordinance appeared to target the <br /> time between 10 p.m. and 7 a.m. Captain DeForrest agreed, adding that Section <br /> 4.080 provided the authority for police officers to respond to noise distur- <br /> bances at other times.
