No. 4339--A resolution forming a local improvement <br /> district for paving, sidewalks, curb and gut- <br /> ters, street lights, and storm sewers on Good- <br /> pasture Island Road 2,000 feet north of Valley <br /> River Drive to 425 feet north of Kingsley <br /> Road. <br />e Mr. Robinette excused himself from the discussion due to a conflict of <br /> interest. Christine Andersen, Public Works Department, stated that staff and <br /> the City Attorney's Office do not agree with the firm of Cleveland & Robinette <br /> that the resolution forming a local improvement district on Goodpasture Island <br /> Road is impermissibly vague. Any development in the district would be <br /> required to undergo the normal permitting process. Item 2(c} concerns <br /> requirements for the assessment to be waived and the circumstances that would <br /> allow the waiver to be voided; it would not permit approval of developments. <br /> Mr. Boles moved, seconded by Mr. Rutan, that Consent Calendar <br /> Item D be approved. <br /> In response to Ms. Bascom's request for clarification, Ms. Andersen explained <br /> that as a part of the current TransPlan, CIP, and the council initiation <br /> process, the project has been the subject of several hearings with property <br /> owners. The road in question has two lanes and no shoulders, and considerable <br /> development has recently occurred along it. Due to bicycle traffic and the <br /> deteriorating pavement condition, the demand for improvements has increased. <br /> The project would permit construction of three traffic lanes, bike paths, a <br /> sidewalk, and curbs and gutters.
