Approval of Minutes, Findings, and Recommendations of the Hearings Official and Adoption of Resolution Forming a Local Improvement District for Paving, Curb and Gutters, Street Lights, and Storm Sewers on Goodpasture Island Road Res. No. 4339--A resolution forming a local improvement district for paving, sidewalks, curb and gut- ters, street lights, and storm sewers on Good- pasture Island Road 2,000 feet north of Valley River Drive to 425 feet north of Kingsley Road. e Mr. Robinette excused himself from the discussion due to a conflict of interest. Christine Andersen, Public Works Department, stated that staff and the City Attorney's Office do not agree with the firm of Cleveland & Robinette that the resolution forming a local improvement district on Goodpasture Island Road is impermissibly vague. Any development in the district would be required to undergo the normal permitting process. Item 2(c} concerns requirements for the assessment to be waived and the circumstances that would allow the waiver to be voided; it would not permit approval of developments. Mr. Boles moved, seconded by Mr. Rutan, that Consent Calendar Item D be approved. In response to Ms. Bascom's request for clarification, Ms. Andersen explained that as a part of the current TransPlan, CIP, and the council initiation process, the project has been the subject of several hearings with property owners. The road in question has two lanes and no shoulders, and considerable development has recently occurred along it. Due to bicycle traffic and the deteriorating pavement condition, the demand for improvements has increased. The project would permit construction of three traffic lanes, bike paths, a sidewalk, and curbs and gutters. The project was brought forward in the capital improvement process.
