Historic Review Board--Jan Muller, Mrs. Dorothy Gilmore; <br />four-year terms ending 1/1/81 were recommended by Mayor <br />Keller. <br /> <br />Mr. Haws moved, seconded by Mr. Hamel that the appoint- <br />ments to the Historic Review Board be approved. Motion <br />carried unanimously. <br /> <br />Approve <br /> <br />2. Garbage Board--Mayor Keller reported appointing Jim Hershner <br />with no set term; other members: Wallace Swanson and Fred <br />Farrand. <br /> <br />File <br /> <br />3. Downtown Development Board--Mayor Keller reported appointing <br />Mike Feig to fill unexpired term of Mayor Keller, term <br />ending 1/1/78. <br /> <br />File <br /> <br />e <br /> <br />J. Cone/Breeden Annexation and Rezoning--Mayor Keller said that <br />at the last Committee-of-the-Whole meeting discussion was <br />held on the possibility of separating the annexation and re- <br />zoning issues for the Council's consideration on February 28. <br />Mr. Saul responded he had discussed this issue with the <br />City Attorney's office and there was no impediment to segre- <br />gating the two items. Mr. Long said ordinarily the Council <br />would consider an annexation issue months prior to making a <br />rezoning decision and that it made sense to him to deal with <br />an annexation first since there would be no need for rezoning <br />if the property were not annexed. He made the distinction <br />that in considering an annexation, it is a political and ad- <br />ministrative matter in which the council can act and accept <br />public hearing in any way it wishes; however, in a rezoning <br />issue, Council would be considering proposals and making a <br />determination of recommendations presented to it operating <br />under the quasi-judicial Fasano proceedings. Mr. Haws indi- <br />cated he agreed to having these two issues as separate items <br />for discussion. Mr. Bradley said he felt the two issues <br />should be discussed, separated by a period of time, with the <br />Boundary Commission approval of the annexation and then <br />Council consideration of rezoning the issue Mr. Saul said <br />he felt the matter as presented to the Council is appropriate <br />and that, in terms of staff time, it makes sense, is more <br />equitable, and more cost effective to all participants to <br />go ahead to consider the items as proposed. Mr. Porter said <br />this rezoning request has a PUD plan with various stages of <br />development and that the present land is zoned as agricultural <br />in the county, which is not in the concept for its use within <br />the city. He said when the property is annexed, the city <br />needs to know how the property will be used when it's annexed. <br />Therefore, he was in favor of considering both the annex <br />and rezoning during the same meeting. <br /> <br />e <br /> <br />Ms. Smith indicated she would abstain from discussion and <br />voting on this matter, both at the Committee-of-the-Whole <br />meeting and the Council meeting. <br /> <br />2/28/77--25 <br /> <br />"I <br />
