Daughters, 1147 High Street. Stan Long, City Attorney, <br />noted there had already been a public hearing on this assessment <br />an? in order for Council to grant hearing, it would require a tw~- <br />thlrds vote. <br /> <br />Mr. Bradley moved, seconded by Mr. Hamel, to open this item <br />for public hearing. <br /> <br />M~. Obie n?ted he w~s not in favor of a public hearing at this <br />~lme, statlng that lf the public hearing were going to be held, <br />lt should be advertised properly. <br /> <br />Vote was taken on the motion, which was defeated with all <br />Council members present voting no, except Mr. Bradley voting <br />aye. <br /> <br />D. League of Ore on Cities Le islative Meetin --Manager reminded <br />Counc~l 0 the meet~ng Sunday, Apr~l 24, ~n Salem and asked <br />if there would be any Council representation. There was no <br />response as to any Council members planning to attend, although <br />City Manager and Mayor would be in attendance. <br /> <br />E. Legislative Subcommittee Report--Manager reviewed the Subcommittee <br />minutes with regard to House Bill 3106 regarding tort liability. <br />He requested that City Council support other provisions of the Bill <br />even though it felt it could not support Section 6. <br /> <br />Mr. Williams noted that the Subcommittee had not been requested <br />to review certain portions of the Bill in detail at its meeting. <br />He said if there were firm recommendations from staff regarding <br />other portions than Section 6, perhaps at the next Legislative <br />Subcommittee committee meeting those portions could be dealt <br />with. Mr. Haws noted he felt the original position taken by <br />the City was the best position and if there were other important <br />issues in the bill, they could be taken up at the next meeting. <br /> <br />Mr. Bradley arrived. <br /> <br />Mr. Williams reviewed reasons for Subcommittee taking its pos~t~on: <br />1) The public and private sectors should be treated similarly in <br />regard to tort liability; and 2) if a person were injured the <br />City should be expected to pay their fair share of costs and to <br />not be treated any differently than other portions of society in <br />regard to its liabilities. <br /> <br />Manager noted this Bill is of critical concern to the League and <br />would probably be discussed at the meeting Sunday in Salem. He <br />asked Council if it might change the wording to "other sections <br />would be supported" rather than "other sections might be support- <br />ed". Mr. Haws noted he was prepared to stand on the position the <br />Subcommittee had taken or go through the Bill item by item. Mr. <br />Williams said he would be willing to take no position if there <br />were going to be some conflict for the Mayor and Manager in <br />meeting with the League Sunday. <br /> <br />-3'f' <br /> <br />4/25/77 - 29 <br />
