2005 Legislative Session IGR Committee Bill Approval June 13, 2005 <br /> <br /> Requires that, when public entity removes, modifies or does not apply land use <br /> regulation in lieu of paying just compensation under Ballot Measure 37 (2004), public <br /> entity's action is personal to claimant. Extinguishes removal, modification or <br /> nonapplication of land use regulation after three years. Declares emergency, effective <br /> HB 3220 2 Support ~on passage. 5/12 <br /> Creates sunset provision for all personal income or corporate excise or income tax <br /> expenditures that are not required under federal law, Oregon Constitution or to avoid <br /> HB 3229 2 Support double taxation. Creates Oregon Tax Expenditure Commission. 4/21 <br /> Requires judgment ordering compensation for claim under Ballot Measure 37 <br /> (2004), to identify date claim for compensation accrued. Authorizes issuance of <br /> supplemental judgment, if original judgment is not satisfied within two years after date <br /> claim for compensation accrued, that allows claimant to use property for purpose for <br /> which claimant could use property when acquired. Declares emergency, effective on <br /> HB 3241 2 Oppose passage. 4/21 <br /> Requires public entity that receives claim for compensation under Ballot Measure 37 <br /> (2004) to conduct public hearing prior to making final decision on resolution of claim. <br /> Requires public entity to provide notice at least 90 days prior to final hearing relating <br /> to claim by first class mail to owners of property within 300 yards of property for which <br /> HB 3242 2 Oppose compensation is claimed. Declares emergency, effective on passage. 4/21 <br /> Declares that decision of public entity to resolve claim for compensation for land use <br /> regulation that purportedly restricts use of private real property and reduces fair <br /> market value of property is not land use decision or limited land use decision and is <br /> not subject to jurisdiction of Land Use Board of Appeals. Establishes necessary <br /> parties and interested parties to resolution, by public entity or by court, of claim for <br /> HB 3243 2 Oppose compensation. Declares emergency, effective on passage. 4/21 <br /> Requires that, when public entity authorizes use of land by removing, modifying or <br /> not applying land use regulation in lieu of paying compensation under Ballot Measure <br /> 37 (2004), waiver of land use regulation is extinguished when property is developed <br /> pursuant to waiver. Declares development use created pursuant to waiver to be <br /> statutorily conforming use that is maintained, improved, replaced or transferred in <br /> same manner as comparable use established without reference to Ballot Measure 37 <br /> HB 3244 2 Monitor (2004). Declares emergency, effective on passage. 4/21 <br /> Prohibits transfer of claimant's interest in judgment entered in action under Ballot <br /> Measure 37 (2004), to anyone other than family member of claimant.
