2005 Legislative Session IGR Committee Bill Approval June 13, 2005 <br /> <br /> Requires owner of private real property claiming compensation under Ballot <br /> Measure 37 (2004), for land use regulation that purportedly restricts use of property <br /> and reduces fair market value of property, to include appraisal of property in written <br /> demand claiming compensation. Delays start of 180-day or more period after which <br /> compensation becomes due and cause of action may be filed until written demand is <br /> HB 3246 2 Support completed by submission of appraisal. Declares emergency, effective on passage. 4/21 <br /> Requires owner of private real property who makes written demand under Ballot <br /> Measure 37 (2004), for just compensation for land use regulation that purportedly <br /> restricts use of property and reduces fair market value of property, to provide title <br /> report or abstract identifying all owners of property for which claim is made. Requires <br /> that all owners be joined in proceedings with public entity or in cause of action to <br /> HB 3247 2 Support resolve claim. Declares emergency, effective on passage. 4/21 <br /> Requires public entity that receives claim for compensation under Ballot Measure 37 <br /> (2004) to review written demand for completeness and conformity to requirements of <br /> Ballot Measure 37 (2004) before paying compensation or granting compensation <br /> exception. Requires public entity to conduct public hearing prior to making final <br /> HB 3248 2 Oppose decision on resolution of claim. Declares emergency, effective on passage. 4/21 <br /> Requires public entity that receives claim for compensation under Ballot Measure 37 <br /> (2004) to conduct one or more public hearings prior to making final decision on <br /> resolution of claim. Authorizes review of final decision of public entity by circuit court <br /> by writ of review. Prohibits review by Land Use Board of Appeals. Declares <br /> HB 3249 2 Oppose emergency, effective on passage. 4/21 <br /> Authorizes existing county service district to undertake construction, maintenance <br /> and operation of up to five types of service facilities without initiating new formation <br /> HB 3250 2 Oppose proceeding. 4/21 <br /> Imposes tax on purchase price of luxury items. Directs Department of Revenue to <br /> deposit moneys in accounts for kindergarten through grade 12 education, community <br /> colleges and state institutions of higher education. Establishes Higher Education <br /> Support Fund. Continuously appropriates moneys in fund to State Board of Higher <br /> HB 3254 2 Support Education. Applies to retail sales of luxury items made on or after January 1, 2006. 4/21 <br /> Modifies conditions under which local contracting agencies must apply procedure in <br /> Public Contracting Code for selecting candidates to provide architectural, engineering <br /> HB 3272 2 Support/Am or land surveying services. 4/21 <br /> <br /> Page 26 <br /> <br /> <br />
