2005 Legislative Session IGR Committee Bill Approval June 13, 2005 <br /> <br /> Moves oversight of vertical housing development zone program from Economic and <br /> Community Development Department to Housing and Community Services <br /> Department. Broadens definition of 'vertical housing development project' to include <br /> projects that have residential and nonresidential uses in any portion of project. <br /> Authorizes Housing and Community Services Department to establish criteria for <br /> determining when to certify property for partial property tax exemption. Encourages <br /> development of residential housing in vertical housing development project that is <br /> reserved for persons or families with limited income. { + Prohibits Housing and <br /> Community Services Department from certifying vertical housing development <br /> projects for partial property tax exemption on or after January 1, 2016. + } Takes <br /> HB 2199B 3 Support effect on 91st day following adjournment sine die. 5/26 <br /> Allows state agency to send notice of intended rulemaking action to interested <br /> HB 2204 3 Neutral persons by e-mail. 2/11 <br /> Establishes rules and procedures for establishing record when petition for judicial <br /> review is filed in circuit court challenging order other than contested case issued by <br /> state agency. Allows person who is qualified to file petition to request that agency <br /> consider additional evidence related to order. Establishes timelines and procedures <br /> for transmission of agency record to court. Awards to agency costs of preparing <br /> record in certain circumstances. Provides that review of order other than contested <br /> case by court is confined to record transmitted to court and certain additional <br /> evidence that may be included in record. Provides that court may not substitute its <br /> HB 2208 3 Monitor judgment for that of agency as to any issue of fact or agency discretion. 2/11 <br /> <br /> Page 46 <br /> <br /> <br />
