The development is a proposed 17 lot subdivision of approximately 16 acres within the City of Eugene. Proposed subdivisions require tentative subdivision plan approval.Tentative subdivision plans are defined as a Type II land use application per EC section 9.7205 and Table 9.7205.Therefore,the standards in EC 9.6791(3)are applicable to this land use application. The standards for stormwater flood control do not apply to development permit applications where the development will be served by a flood control facility that is a manmade drainage system designed to accommodate the runoff generated by the basin area.The development site is served by a manmade drainage system that was designed to accommodate the stormwater runoff generated by the stormwater basing area.However,the proposal here is a land use application and not a development permit. (3)Standards. (a)Stormwater flood control facilities shall be designed and constructed according to adopted plans and policies,and in accordance with standards in EC Chapters 6 and 7,and the stormwater flood control provisions and the facility design requirements set forth in the Stormwater Management Manual. This standard requires that all flood control facilities are designed and constructed according to adopted plans,policies,provisions,and standards.The development is proposing to design and construct a system of publicly owned and operated stormwater pipes and water quality facilities to serve all streets and lots in the subdivisions.Sheets C5.0 and C5.1 of the subdivision plans (see Exhibit B.2)show the proposed stormwater piping systems in the proposed public rights of way and proposed public easement areas.The conceptual piping systems and water quality facilities are designed and sized in conformance with the Public Improvement Design Standard Manual (latest edition)and the Stormwater Management Manual (latest edition).The proposed stormwater pipes connect to existing public stormwater pipes with the capacity to serve the development site in accordance with City design standards. A discussion and verification of stormwater service capacity can be found in section EC 9.6791(3)(b) below.The site bisects 2 existing planned stormwater sub basins.The southern portion of the site is served by the existing mill race drainage pipes (existing 60"concrete pipe leading to City of Eugene stormwater outfall node 65028)and the northern portion of the site is served by the existing 36 inch stormwater pipe that outfalls to the east of the existing EWEB headquarters building (City of Eugene stormwater outfall node 65027).The points of connection are consistent with adopted Stormwater Basin Master Plans (Willamette River Basin,Volume 6 of 7).The adopted stormwater master plans did not identify any existing or future capacity deficiencies.The percentage of proposed impervious areas allowed under the S-DR zone is consistent with the existing high level of impervious areas from the prior industrial uses.All public streets are curbed to collect and control stormwater to appropriate drainage facilities and structures.The stormwater system is extended to all lots in the subdivision for service.All conveyance piping and water quality facilities will be designed and constructed in conformance with applicable,codes,polices and standards.Therefore,the development is consistent with this standard.
