Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />Furthermore,the discussion in EC 9.6791(3)(b)demonstrates stormwater runoff from the <br />development site is directed to the Willamette River through established man-made flood control <br />facilities and outfalls.Stormwater from the development site is not directed to facilities under the <br />jurisdiction of the Junction City Water Control District.Therefore,this standard is not applicable. <br />(4)Underground Injection Control Systems.Stormwater runoff discharged in <br />underground systems is also regulated through the federal Underground <br />Injection Control (UIC)program under Part C of the Safe Drinking Water Act <br />(42 U.S.C.§300,Chapter 6A,Subchapter XII)and Oregon Administrative Rule <br />Chapter 340,Section 044. <br />This standard acknowledges that UIC's are not directly regulated by the NPDES MS4 permit and the <br />City of Eugene beyond the verification of flood control standards identified in EC 9.6791(3)(a)and (b) <br />of this code.UIC's have applicable statutes and regulation under the jurisdiction of the Oregon <br />Department of Environmental Quality (0DEQ)and require additional permitting directly through a <br />state agency.The development proposes to discharge all stormwater runoff into existing conveyances <br />that outfall to established surface waters not under the jurisdiction of UIC regulations.No UIC's are <br />proposed with this development.Therefore,the standards of EC 9.6791(4)are not applicable.Any <br />UIC proposed with a future development permit shall be subject the standard of EC 9.6791(4)and the <br />time of development permit application. <br />EC 9.6792 Stormwater Quality. <br />(2)Applicability and Exemptions. <br />* * * <br />(f)The standards in EC 9.6792(3)do not apply to land use applications or <br />development permit applications within the S-DR Downtown Riverfront <br />Special Area Zone.Instead,the standards at EC 9.3155(17)apply. <br />The standards at EC 9.6792 for Stormwater Quality do not apply to land use applications or <br />development permit applications within the S-DR Downtown Riverfront Special Area Zone.This <br />development is fully within the S-DR Downtown Riverfront Special Area Zone,so the standard at EC <br />9.3155(17)applies instead.The following includes findings demonstrating consistency with the <br />standards of the S-DR Downtown Riverfront Special Area Zone. <br />EC 9.3155 S-DR Downtown Riverfront Special Area Zone General Development Standards <br />(applicable to all property). <br />(17)Stormwater Quality Control Standards.The Stormwater Quality Control <br />standards at EC 9.6792(3)are not applicable in the S-DR Zone.The following <br />standards apply,instead. <br />(a)For land use applications proposing the construction of a public or <br />private street,stormwater facilities shall be selected from the <br />Stormwater Management Manual and may be sized to also treat some or <br />all the stormwater runoff from future development on lots adjoining the <br />street. <br />City of Eugene FINAL SUBMITTAL 76July 17, 2019, Work Session – Item 2
