Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />This standard requires the construction of water quality facilities in conformance with the Stormwater <br />Management Manual for land use applications proposing the construction of a public or private street. <br />The development is proposing the construction of public streets to serve the development site. <br />Stormwater facilities have been selected from the Stormwater Management Manual to treat all <br />impervious surfaces in the proposed public streets.The stormwater treatment plans shown on sheets <br />C7.0 and C7.1 of the application show the conceptual location of the water quality facilities.The <br />stormwater memo from KPFF,dated March 2019 (see Exhibit J)calculates the runoff from the <br />required water quality design storms and calculates the required treatment area.The development <br />has also proposed to oversize the treatment facilities to accommodate the stormwater runoff from <br />future lots on adjoining streets.The development has proposed to capture and treat stormwater <br />runoff from the existing Ferry Street viaduct to be used as an equivalent on-site treatment area,as <br />allowed by the Stormwater Management Manual,for hydraulically isolated areas and future buildings <br />with zero lot line construction where a traditional vegetated water quality facility is difficult or <br />impossible to implement.The technique also allows the development to capture and treat existing <br />high pollutant runoff that would otherwise be discharged to the Willamette River untreated.This <br />better meets the City's permit requirements consistent with the intent of this standard.The specific <br />design and size of the facilities will be further refined in the public improvement design process.The <br />potential treatment capacity will be made available to adjoining lots,to potentially be utilized under <br />agreement as allowed in EC 9.3155(17),and will be documented as a part of the public improvement <br />process.Therefore,this standard is met. <br />(b)Applications for a development permit shall comply with (17)(c)at the <br />time of development permit application unless the applicant has <br />entered into an agreement with the City of Eugene demonstrating that a <br />stormwater facility approved pursuant to (a)will treat all of the <br />stormwater runoff from the development being proposed by the <br />applicant. <br />The proposed tentative subdivision is a land use application and does not include any associated <br />development permits.Therefore,this standard does not apply to the tentative subdivision.Future <br />development of buildings and other site improvements on individual lots created by the subdivision <br />will need to conform to the standard at the time of permits. <br />(c)An application for a development permit that is not exempt under (b), <br />including an application pertaining to a development that is subject to <br />an agreement with the City of Eugene demonstrating that a stormwater <br />facility approved pursuant to (a)will treat some,but not all,of the <br />stormwater runoff from the proposed development: <br />Shall include stormwater quality facilities selected from the <br />Stormwater Management Manual based on the following priority <br />order:infiltration,filtration,off-site stormwater quality <br />management. <br />1. <br />If selecting a filtration treatment facility,shall include a report <br />that demonstrates at least one of the following development site <br />conditions exist: <br />2. <br />Infiltration rates are less than 2 inches per hour;a. <br />City of Eugene FINAL SUBMITTAL 77July 17, 2019, Work Session – Item 2
