Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />b.Bedrock is less than 5 feet below the ground surface; <br />Groundwater elevations are less than 6 feet;or,c. <br />d.Ground surface slopes are greater than 10%. <br />3.If selecting off-site stormwater quality management by <br />contributing to the public off-site stormwater quality facilities, <br />through payment of a higher stormwater system development <br />charge adopted as part of the City's system development charge <br />methodology,shall include a report that demonstrates there is <br />insufficient land area to construct an approved infiltration or <br />filtration facility by setting forth the required size of the smallest <br />infiltration or filtration facility needed for the development's <br />impervious surface area and a site plan demonstrating that an <br />approved infiltration or filtration facility cannot be located on the <br />development site without reducing the size of the proposed <br />development which is otherwise consistent with all other <br />applicable lot and development standards. <br />4.Shall design the selected stormwater quality facilities to treat all <br />stormwater runoff from all new or replaced impervious surface <br />areas,or an equivalent on-site area,that will result from the <br />water quality design storm,in combination with any agreement <br />with the City for off-site treatment of some stormwater runoff <br />from the proposed development site.The selected stormwater <br />quality facility does not need to treat the stormwater runoff from <br />new or replaced impervious surface that is 500 sq.feet or less and <br />does not gravity-feed into the selected treatment facility. <br />5.Shall site,design and construct all stormwater quality facilities <br />according to the water quality provisions and the facility design <br />requirements set forth in the Stormwater Management Manual. <br />6.The standards in EC 9.3155(17)(c)maybe adjusted based on the <br />criteria set out at EC 9.8030(24)(a)and (b). <br />The proposed tentative subdivision is a land use application and does not include any associated <br />development permits.Therefore,this standard does not apply.Future development of buildings and <br />other site improvements on individual lots created by the subdivision will need to conform to the <br />standard at the time of permits. <br />EC 9.6793 Stormwater Flow Control (Headwaters). <br />The standards set forth in EC 9.6793(3)protect headwaters streams from the erosive effects of <br />increased stormwater runoff from development.The standards for Stormwater Flow Control apply to <br />all land use applications for development sites within a headwaters stream or pipe that discharges into <br />a headwater steam.The development site is not located in the headwater areas.It does not discharge <br />stormwater to a head waters steam or a pipe that discharges to a headwaters stream.Therefore,the <br />standards set forth in EC 9.6793 are not applicable to this application. <br />City of Eugene FINAL SUBMITTAL 78July 17, 2019, Work Session – Item 2
