Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />EC 9.6794 Stormwater Oil Control. <br />The standards set forth in EC 9.6794 protect the City's stormwater system from impervious areas on <br />properties that produce high concentrations of oil and grease in stormwater runoff.The standards for <br />Stormwater Oil Control apply to certain types of development on properties with the characteristics <br />listed in EC 9.6794(2)(a-d).As the proposed subdivision does not include specific development plans <br />for individual lots to be created by the subdivision,an evaluation of these standards (to the extent <br />applicable)will occur at the time of future building and site development permits. <br />EC 9.6795 Stormwater Source Controls. <br />The standards set forth in EC 9.6795(3)prevent stormwater pollution by eliminating pathways that <br />may introduce pollutants to stormwater.The standards for Stormwater Source Control apply to <br />certain types of development on properties with the characteristics listed in EC 9.6795(2)(a-h).As the <br />proposed subdivision does not include specific development plans for individual lots to be created by <br />the subdivision,an evaluation of these standards (to the extent applicable)will occur at the time of <br />future building and site development permits. <br />EC 9.6796 Dedication of Stormwater Easements. <br />The standards set forth in EC 9.6796 ensure that City maintained stormwater facilities can be accessed <br />for routine and emergency maintenance.The standards for Dedication of Stormwater Easements <br />apply to all land use applications and development permits that result on the construction of City <br />maintained stormwater facilities.The proposed subdivision includes the conceptual design and <br />construction of City maintained stormwater facilities.Therefore,the standards set forth in EC 9.6796 <br />apply to this development. <br />(3)Standards.The applicant must dedicate public easements approved by the <br />city over city maintained stormwater management facilities provided the city <br />makes findings to demonstrate consistency with constitutional requirements. <br />The conveyance of ownership or dedication of easements may be required in <br />any of the following circumstances: <br />(a)Except for areas on the city's acknowledged Goal 5 inventory,where the <br />subject property in the proposed development is or will be periodically <br />subject to accumulations of surface water or is traversed by any open <br />drainage way,headwater,stream,creek,wetland,spring,or pond, <br />including those not maintained by the city which drain onto or from <br />city-owned property or into city maintained facilities. <br />(b)For areas on the city's acknowledged Goal 5 inventory,where the <br />subject property in the proposed development is or will be periodically <br />subject to accumulations of surface water or is traversed by any water <br />course or channel. <br />(c)Where necessary to extend public drainage facilities and services to <br />adjoining undeveloped property. <br />(d)T o provide necessary drainage from the public right-of-way. <br />City of Eugene FINAL SUBMITTAL 79July 17, 2019, Work Session – Item 2
