<br />FIRE CHIEF, CHIEF OFFICER, OR CHIEF OF THE DEPARTMENT is <br />the City Manager or his or her designee. <br /> <br />PERMIT includes permits with conditions. <br /> <br />PERSON RESPONSIBLE means an agent, occupant, lessee, tenant, contract <br />purchaser, owner, permit holder, facility owner, or other person in possession or <br />control of the facility, or hazardous materials or of a facility at which hazardous <br />materials are located. <br /> <br />STORAGE FACILITY is anyone or combination of tanks, sumps, wet floors, <br />waste treatment facilities, pipes, vaults, rooms, buildings, portions of buildings or <br />other portable or fixed containers, used, or designed to be used, for the storage of <br />hazardous materials. <br /> <br />THREATENED RELEASE is a condition creating a substantial probability of <br />harm, when the probability and potential extent of harm make it reasonably <br />necessary to take immediate action to prevent, reduce, or mitigate damages to <br />persons, property, or the environment. <br /> <br />9. The definition for "Open Burning" in Section 302 of the OFC is amended to <br />provide: <br /> <br />302 OPEN BURNING. The burning of materials wherein products of combustion are <br />emitted directly into the ambient air without passing through a stack or chimney <br />from an enclosed chamber or as regulated by Lane Regional Pollution Authority <br />and Section 6.200 of the Eugene Code, 1971. Open burning does not include road <br />flares, smudge pots and similar devices associated with safety or occupational uses <br />typically considered open flames or recreational fires. For the purpose of this <br />definition, a chamber shall be regarded as enclosed when, during the time <br />combustion occurs, only apertures, ducts, stacks, flues or chimneys necessary to <br />provide combustion air and permit the escape of exhaust gas are open. <br /> <br />10. Section 307.1 of the OFC is amended to provide: <br /> <br />307.1 General. Open burning is not allowed. <br />EXCEPTIONS: <br />1. Fires set and maintained for fire fighting training or training fire protection <br />personnel. <br />2. Fires set and maintained for abating, alleviating or removing a fire hazard <br />if authorized by written permit of the fire marshal. <br />3.
