Utility Construction and Use of the Right-of-Way Policies and Procedures Manual Page 4 <br />Utility Easement: Public utility easements (PUE’s) are made available for the installation <br />and maintenance of City infrastructure, and licensed and franchised utility facilities. The <br />City, municipal utilities, telecommunications, and licensed and franchised utilities and their <br />operators and designated contractors shall be permitted to access the property with the <br />express purpose of gaining access to established Public utility easements. <br /> <br /> <br />2 PERMITS <br /> <br />2.01 Public Way Use Permits <br /> <br />2.01.1 General <br />Pursuant to EC 7.290, no person, municipal utility, or operator of a communications system <br />shall do work affecting the public way without first obtaining the appropriate permits <br />required by the City. Public Works Maintenance Utility Coordinator staff issue the <br />following Public Way Use Permits and Exceptions: <br /> <br />1. Utility Permits <br />a. Individual Utility Permit <br />b. Annual Blanket Utility Permit <br />2. Street Cut Moratorium Exception <br /> <br />Utility providers may request Utility Permits for individual site installations or an annual <br />blanket permit for on-going operation and maintenance activities which meet certain <br />criteria discussed in Section 2.03. <br /> <br />A Public Way Use permit is required for activity that affects the public way including, but <br />not limited to, installation, or construction of any structure, pipe, pole, conduit, culvert, or <br />facility, including a communications facility as defined in EC 3.005; or other wire line <br />infrastructure in or on a public way, and any construction, reconstruction, grading, oiling, <br />repair, opening or excavation of a public way for any purpose, but does not include the <br />construction of public improvements performed under a contract executed by the City <br />Manager or work performed by City employees under the City Manager's direction. <br /> <br />Issuance of a permit for work within the public way does not relieve the permittee from the <br />responsibility to obtain other necessary permits and to conform to other regulatory <br />requirements.
