15 <br />2) The Flying Club specifically does not offer or conduct retail fuel sales, retail <br />mechanic services, charter services, air taxi operations, or Aircraft Rental <br />operations. <br /> <br />3) The Flying Club does not permit its Aircraft to be used for flight instruction for any <br />Person, including members of the Flying Club, if such Person pays or becomes <br />obligated to pay for such instruction. Flight instructors who are also Flying Club <br />members may not receive payment for instruction except that they may be <br />compensated by credit against payment of dues or flight time. <br /> <br />i. Insurance shall be provided and paid for by the Flying Club at the levels established by the <br />Airport Director. <br /> <br />II. Violations <br /> <br />a. If a Flying Club is determined to be in violation of the Rules and Standards, the Airport <br />Director will notify the Flying Club in writing of such violations and identify a reasonable <br />cure period in the notice. If the Flying Club fails to correct or initiate reasonable progress <br />toward correcting, in the opinion of the Airport Director, these violations within the cure <br />period provided In the notice, the Airport Director is authorized to penalize noncompliance <br />in the following manner, depending on the nature and severity of the violation: <br /> <br />1) Terminate a Self-fueling Permit or other form of Agreement and prohibit Self- <br />Servicing of Flying Club Aircraft. <br /> <br />2) Require Flying Club or club members to apply for the right to conduct a Commercial <br />Aeronautical Activity in accordance with Subdivision III (Minimum Standards) <br />hereof and comply with the Minimum Standards. <br /> <br />3) Require a Flying Club to cease all operations on the Airport. <br /> <br />4) Impose such other penalties as are authorized in Section C herein. <br /> <br />SECTION G. -- OTHER POLICIES <br /> <br />I. Special Aeronautical Events <br /> <br />Any Special Aeronautical Event held on the Airport by any Tenant or other Airport user, <br />organization, civic, or government entity must be conducted in accordance with an Agreement <br />executed prior to the start of the Special Aeronautical Event. The Agreement shall specify the dates <br />and times of the Special Aeronautical Event; areas of the Airport authorized for use during the <br />Special Aeronautical Event; insurance and indemnification to be provided by the Special <br />Aeronautical Event sponsor; fees (if applicable); means to ensure safety and security during the <br />Special Aeronautical Event; special arrangements for Aircraft parking and staging; arrangements <br />for crowd control and pedestrian access to the AOA; arrangements for parking of vehicles and fees <br />(if applicable); concession offerings (if applicable); waste control and refuse removal; post event <br />clean up: reimbursement for City costs to support the event; and such other terms and conditions <br />as the Airport Director may require. <br /> <br />II. Through-the-Fence Operations <br /> <br />The City has determined that Through-the-Fence Operations by Aircraft or for the provision of <br />services to Aircraft on the Airport have the potential to compromise safety and the efficient use and <br />operation of the Airport and/or undermine the providing of Commercial Aeronautical Activities by <br />authorized Commercial Aeronautical Operators operating under an Agreement on the Airport. The <br />City will not authorize a Person to conduct an Aeronautical or Non-Aeronautical Activity requiring <br />through-the-fence access at the Airport. Any violations may cause an Agreement executed with the <br />Person receiving the benefits of the service to be terminated.
