22 <br />the preceding provision of the Rules and Standards concerning the safe operation of <br />Aircraft on the Airport. <br /> <br />f. As provided in FAA regulations and Oregon law, no Person shall operate or have actual <br />physical control of any Aircraft while under the influence of alcohol, illegal drugs, or other <br />illegal controlled substances. This provision is intended to provide an additional mechanism <br />to ensure safe aircraft operations by requiring compliance with FAA regulations, currently <br />found at 14 C.F.R. § 91.17, and Oregon law. This provision is not intended to create new <br />or different standards than provided in FAA regulations or Oregon law. <br /> <br />g. No Person shall have in his possession while in the cockpit of any Aircraft any bottle or <br />receptacle containing any alcoholic beverage which has been opened, or the seal broken, <br />or the contents of which have been partially removed. <br /> <br />h. No Person shall land at, take off from, or taxi on the Movement Areas of the Airport in an <br />Aircraft that is not equipped with a functioning radio transmitter and receiver. In the event <br />of inadvertent radio failure, standard light signals shall be observed. <br /> <br />i. Any Aircraft owner or operator causing damage to City property, as determined by the <br />Airport Director shall be fully liable to the City for repair of any such damage on a timely <br />basis, plus any administrative fee per the current Airport schedule of rates, fees and <br />charges, due and payable upon demand, in addition to any other penalties prescribed <br />herein. <br /> <br />j. Snow removal by the City will be limited to those areas identified in the Airport Snow and <br />Ice Control Plan, on file in the office of the Airport Director. Snow removal in Lease <br />Premises is the responsibility of the Tenant unless stipulated otherwise in an Agreement. <br />Snow removal by Tenants must not impede the ground movement of Aircraft and Ground <br />Vehicles; be deposited in space that will require the City to conduct additional removal; <br />create a hazard to air navigation; cause a risk of engine ingestion; or otherwise present a <br />risk to Persons or property. <br /> <br />II. Parking, Ground Movement and Engine Run-Up <br /> <br />a. Aircraft cannot be parked or stored at the Airport except in areas designated by the Airport <br />Director for such purposes. Aircraft Operators are solely responsible for properly securing <br />the Aircraft while parked or stored to avoid damage to other Aircraft or buildings and for <br />maintaining the Aircraft in a safe and mobile condition. <br /> <br />b. eVTOL Aircraft may only operate in designated areas. Operators must submit to the City <br />operating procedures supporting the safe movement of passengers. Written approval of all <br />such plans must be received prior to operation of eVTOL Aircraft on the Airport. The City <br />reserves the right to charge operators for the use of Airport facilities. <br /> <br />c. No Aircraft shall be left unattended on the Airport unless it is in a hangar or adequately <br />secured on a designated Aircraft parking ramp or Common Use Areas of the Airport. <br /> <br />d. All Airport users shall have the right in common with others so authorized to use Common <br />Use Areas of the Airport. Common Use Areas shall be kept clear and available for Aircraft <br />traffic to comply with intended use. No one shall use any Common Use Area for parking or <br />long term storing of Aircraft, equipment, or vehicles. Common use designations may be <br />changed from time to time by the Airport Director. <br /> <br />e. Aircraft shall not be parked so as to block movement on taxiways, taxilanes, public ramps, <br />or in Common Use Areas. At the direction of the Airport Director the operator, owner, or <br />pilot of any illegally parked Aircraft on the City shall move Aircraft to a legally designated <br />parking area on the Airport.
