40 <br />self-fueling are subject to Subdivision II (Rules and Regulations) hereof and the terms of <br />an Agreement. <br /> <br />g. No Person may conduct a Commercial Aeronautical Activity or Non-Commercial <br />Aeronautical Activity at the Airport that is not expressly addressed in the Minimum <br />Standards without the City’s prior written approval. In reviewing a request, the City will <br />consider the nature of the Commercial Aeronautical Activity and Non-Commercial <br />Aeronautical Activity, the proposed business terms, and the compatibility of the <br />Aeronautical Activity with then-existing Airport operations and activities. The City further <br />may request review by the FAA to consider, for example, and without limitation, whether <br />the Aeronautical Activity may be conducted safely at the Airport. The City may decide, at <br />its sole discretion, to amend the Minimum Standards prior to executing an Agreement <br />authorizing the new Commercial Aeronautical Activity or Non-Commercial Aeronautical <br />Activity to, for example and without limitation, create a new category of Commercial <br />Aeronautical Operator with attendant requirements and standards. The Airport Director <br />shall consider the following criteria in determining if a Person shall for authorized for <br />Commercial Aeronautical Activity or Non-Commercial Aeronautical Activity at the Airport: <br /> <br />1) The terms and conditions of any pre-existing commercial operators at the Airport <br />providing comparable services; <br /> <br />2) The impact of the proposed Commercial Aeronautical Activity or Non-Commercial <br />Aeronautical Activity on public safety and convenience; <br /> <br />3) The amount of available space at the Airport; <br /> <br />4) The customary uses of the Airport; <br /> <br />5) Compatibility of the proposed new Commercial Aeronautical Activity or Non- <br />Commercial Aeronautical Activity with present and planned development at the <br />Airport; <br /> <br />6) Compliance of the proposed Commercial Aeronautical Activity or Non-Commercial <br />Aeronautical Activity with all federal, state, and local laws and <br /> <br />7) Equitable treatment of Commercial Aeronautical Activity and Non-Commercial <br />Aeronautical Activity providers on the Airport. <br /> <br />h. If a Commercial Aeronautical Operator conducts multiple Aeronautical Activities under a <br />single Agreement, that Commercial Aeronautical Operator must comply with the Minimum <br />Standards established for each separate activity. If the Minimum Standards for one <br />Commercial Aeronautical Activity are inconsistent with the Minimum Standards for another, <br />then the stricter or higher Minimum Standards apply to all Commercial Aeronautical <br />Activities of that Commercial Aeronautical Operator. <br /> <br />i. No Person may conduct a Commercial Aeronautical Activity or Non-Commercial <br />Aeronautical Activity at the Airport in support of an Aeronautical Activity that is prohibited <br />by the FAA, the State of Oregon, or the City. <br /> <br />j. Persons conducting Non-Commercial Aeronautical Activities shall be subject to these <br />Minimum Standards. The City may establish a Non-Commercial Aeronautical Activity rates, <br />fees and charges schedule that may vary from the Commercial Aeronautical Activities <br />rates, fees, and charges schedule. <br /> <br />III. Waivers and Variances <br /> <br />a. The Airport Director may waive all or any portion of the Minimum Standards for the benefit <br />of any government or government agency performing public or emergency services,
