If the app1 i cant <br />fai 1 s to obtai n a bui 1 di ng permit within the time period specified i n connection <br />with the fi na1 plan approval , or i n the absence of a sped fi ed time period, <br />within one year of final p1 an approval , final plan approval expires . Prior to <br />expiration of tentative p1 an approval , the hearings authority responsible for <br />approva 1 may , i f requested , extend the schedule , provided i t i s not contrary to <br />the public interest or findings required in response to approval criteria. <br />Unless the hearings offi ci a1 provides otherwise, expi rati an of fi na1 p1 an <br />approval of any phase automatically voids approval of al 1 phases on which <br />construction has not begun. <br />Section 21. Subsections (2), (6)(a), (6)(c)3., and (6)(j) of Section 9.512 <br />of the Eugene Code, 1971, are amended, and a new Subsection (6)(c)5. is added <br />thereto, to provide: <br />9.512 Tentative Plan Consideration. <br />(2) Annlication. A tentative plan application and related <br />information as prescribed by the city shall be submitted for all contiguous <br />property under the same ownership by the owner of the affected property, together <br />with a fee established by the city manager as provided by section 2.020 of this <br />code. <br />~ 6 } i i Unless .the applicant agrees to a 1 onger time period , <br />the hearings offi ci a1 shal 1 approve, conditionally approve, or deny a tentati ve <br />plan application with findings and conclusions thereon , within 15 days fol 1 owi ng <br />the close of the public hearing and the record. Within five days after the <br />decision i s rendered , the hear? ngs official shall ma i 1 a noti ce thereof to the <br />app1 i cant , coordinator , and persons who have requested notification . Apprava 1 <br />or denial shal 1 be based on the fu11 development , i nc1 udi ng the campl ete street <br />network and al 1 street connections . Phasing of portions of the development may <br />occur as part of final approval .
