public, Mr. Mel Lemxnon, testified at the hearing. Mr. Lemmon was concerned that the <br />construction had adversely impacted the drainage on his property. Staff have subsequently <br />reviewed the situation and are making the necessary minor adjustments to address this issue. <br />Based upon the information provided by the City Engineer's office and testimony offered at the <br />March 1,1999 public hearing, the Hearings Official finds that the final improvement costs <br />proposed to be assessed are lower than those quoted at the local improvement hearing and are <br />comparable to or lower than projects of similar size. The Hearings Official further finds that the <br />proposed assessments are calculated in accordance with the Eugene Code and that the pro ject is <br />one for which the assessments are for a local improvement asset forth in ORS 310.140 because: <br />~ 1 } The assessments do not exceed actual costs; <br />~2} The assessments are imposed for a Capital Improvement Construction Project which <br />provides a specific benefit to a specific property or rectifies the problem caused by a <br />specific property; <br />~3} The assessments are imposed in a single assessment upon completion of the project; and <br />~4} The assessments allow the property owners to elect to pay off with interest over at least <br />ten (10}years. <br />Therefore, the Hearings Official recommends that the City Council approve the assessment as <br />calculated and that the Council levy the final assessment. <br />Respectfully submitted, <br />Gar .
