tartly, that sign shall thereafter conform to the requirements of <br />the Eugene sign code as a newl y constructed sign . <br />~c} Any sign which is constructed to replace a nonconforming <br />s~ gn shall be constructed ~ n compliance with all applicable provi - <br />s~ons of the Eugene sign code. <br />~2} Whenever a nonconforming sign is damaged or destroyed to the <br />extent of 50 percent or 1 ess of its value as of the 1 ast date of use, i t may <br />be restored and the use of the sign which existed at the time of the damage <br />or destruction may be continued, i f such restoration i s started within a <br />pert ad of 90 days of such damage or destruction and i s di 1 i gently pursued <br />thereafter. <br />~3} Except where only a change in display copy is made, any non- <br />conform~ ng s ~ gn wh ~ ch ~ s structural 1 y altered or has i 11 umi Hatt on instal 1 ed <br />shall be brought rota compliance with all applicable provisions of the Eugene <br />s ~ gn code wi th ~ n 90 days and shall thereafter be kept i n compliance with the <br />Eugene sign code. <br />~4} All nonconforming signs shat 1 be removed or brought into com- <br />pl~ance with the Eugene sign code as adapted on July 25, 1990, by June 31, <br />2000, except that signs with a surface area of 200 square feet or greater <br />shal 1 be removed or brought into compliance with the Eugene sign code as <br />adopted on July 25, 1990 by June 31, 1997. <br />~5} Nothing i n this section shall be deemed to prevent the mat nten- <br />ance of any sign, or regular manual changes of sign copy on a sign intended <br />for such purposes. <br />~fi} .The provisions of subsection ~4} of this section do not apply <br />to signs ~n existence pursuant to a validly issued sign permit as of July 1, <br />1990 along Goodpasture Island Road from a point 300 feet north of the inter- <br />section with valley River Way to a paint 1400 feet north of the intersection. <br />The provisions of subsection ~2} of this section shall apply except that res- <br />toration of a damaged sign shall be allowed where a sign is damaged to the <br />extent of 1009 of its value. A <br />sign permit for the construction and continued use of a sign shall be subject <br />to the the terms and conditions stated i n the permit and to the Eugene sign <br />code . <br />~ 2 } Failure to abide by the terms of a s i gn permit or appl i cabl e <br />provisions of the Eugene sign code shall inval idate a sign permit. The city <br />manager may take such steps as are necessary to abate such a sign as a public <br />nuisance. <br />9.1014 S i n Code „- Permi t.,,,.
