9.1037, 9.1039, 9.1041, and 9.1050 are added to the Eugene Code, 1971, to <br />provide: <br />Eu ene Si n Code <br />9.1000 Si n Cade - Pur ose and 5ca e. The purpose of the Eugene sign code <br />i s to protect the health, safety, property and welfare of the <br />public by establishing standards for the design, quality of materials, con- <br />struct i an, size, number, 1 ocati on, e1 ectri f i cati on, i 11 umi nati on, instal 1 a- <br />t i on and maintenance of al 1 signs and sign structures not 1 orated within a <br />building. The provisions of the Eugene sign code shall apply to all signs <br />1 orated within the juri sdi cti vn of the city. The regulations are not i n- <br />tended to, and da not restrict the content of sign messages. The counci 1, <br />after due deliberation, and after a public hearing, hereby finds and declares <br />that: <br />~a} The people 1 iving within the jurisdiction of the city have <br />a primary interest i n control 1 i ng the construction, location and <br />maintenance of outdoor signs in a manner designed to protect the <br />public health and safety and to promote the pub1 i c welfare. <br />fib} Careful monitoring of the effectiveness of the sign code <br />i s necessary to ensure that the code accomplishes its purposes i n <br />the face of changing sign usage and public expectations . <br />~c} Private signs make use of a publ is resource by seeking <br />to communicate with persons using the public way. It is necessary <br />to regulate such signs to assure that they do not interfere with <br />other uses of the public way. <br />~d} It i s necessary to the public safety that official traff i c <br />regulation devices be easily visible and free from nearby visual <br />obstructions and distractions, such as flashing signs, an excessive <br />number of signs, ar signs in any way resembling Official signs, <br />fie} The construction and maintenance of outdoor signs must be <br />regulated tv assure that improper practices do not result i n hazard- <br />ous conditions far the public, <br />~ f } The Eugene/Springfield Metropolitan Area General Plan <br />identifies visual access to natural 1 and features and waterways <br />and the preservation of the distinctive qualities of 1 oral and <br />neighborhood areas as important objectives to be served in the <br />cvordi Hated development of the metropal i tan area. It i s necessary <br />to regulate the number, type and 1 ocati on of signs to accampl i sh <br />the purposes of the Metropolitan Plan. <br />fig} Proliferation of signs seriously detracts from the pl ea- <br />sure of observing the natural scenic beauty and the human envi ran- <br />ment of the city. <br />~h} It is necessary to protect residential neighborhoods from <br />the adverse impact that signs may have on the residential atmos- <br />phere. <br />~ i } It i s necessary to regulate the size, type and location <br />of signs to encourage the effective use of signs as a means of <br />communication and tv provide equality and equity among sign users <br />and those who wish to use signs . <br />ordinance - 6 <br />
